Dear friends, the customer presented his retirement-benefit-cheque into Nationalized Bank whereat he and his institution also have the accounts. Hence, As the same bank is a computorized branch , immediately his cheque was honoured and the same was accounted into his account. on the same day , within minutes, the same customer's another cheque issued to his friend was presented and the same was also honoured and transferred into his friend's account . Subsequently , the customer presented his cheque for withdrawal , there is no sufficient balance in his account due to his friend's collection of customer's cheque. now ,the question is ' is it lack of deficiency of service'. Any land mark judgement? thanks in advance.

Respected Sir,
Pl inform about -
1. Is it mandatory to register the trust deed?
2. If compulsory who is the registration authority and what are the registration fees?
3. What is the time frame for registration of trust?
4. Is the registration fees payable in addition to the stamp duty payable under the Stamp Act?
5. Should the deposit of title deed be made before trust registration or at the time of registration or after the registration?
6. Is there any document /return to be filed with ROC or any other authority before issue of debentures , as in the case of Share issue where prospectus or statement in lieu of prospectus is due?
7.Can it issue unsecured debentures or only secured?
8. Is. debenture trust deed mandatory since SEBI guidelines do not apply to unlisted companies?
Pl inform with quoting/refering the relevant provisions, as this is highly important and required for the job.

Kindly Provide the latest ruling on the Dishonour of the Security Cheque, whether Security Cheque deposited with the Bank attracts the Provision of Section 138 of N.I. Act more particularly when blank cheque is given &new oder?

An e-mail communication between two or more persons regarding any matter in a case is an documentry evidence to produced in court in hard copy of that email.
An e-mail hard copy after print is documentry evidence. So pls. provide the case on. where the email is a documentry evidence.
