Hello Experts,
ABC Private Limited has taken a loan from a former director (Ms XYZ) who exited the company and now only holds a token 10 shares. She had given a loan of Rs 3 lakhs on March 1, 2012 (when she was a director). The notarised loan agreement, which has been signed by both parties on January 1, 2013, has these two conditions-
"Interest: ABC Pvt Ltd shall pay to Ms XYZ interest on the principal amount of the Rupee Loan outstanding from time to time half-yearly on July 1 and January 1 in each year at the rate of 15% per annum from the date of this agreement"
"No additional payments of any kind whatsoever are due from ABC Pvt Ltd to Ms XYZ, including for any services that she provided to The Borrower in her capacity as a Director"
Now Ms XYZ is claiming that the interest is due starting from February 1, 2012 whereas ABC Pvt Ltd is of the opinion that the interest is due starting from January 1,2013 as that was the date of agreement. Can Ms XYZ claim interest from a previous date under any condition? The loan was interest free when it was given by the directors initially.
I think that ABC private limited is correct and that Ms XYZ cannot claim a higher interest but would like to get your expert opinions.

My grandpa had been offered a credit card of Rs 10,000 value of HDFC thru some agent ,which he availed but during no dues process it had Rs 1200 as pending due ,which my grandpa being illiterate handed the amount to same agent and in return the agent gave a statement of receipt on a plain paper and a cash deposit receipt(account no and amount metioned) of HDFC, both without any stamp n attest by HDFC bank assuring that no due would be issued soon .But he fled away with the amount without depositing in the bank and from than on(2006) till now the due has accrued upto Rs 1.72 lakh as pending due as they kept on calculating with 2.45% monthly compounding .They are now continuously sending notices stating that a case would be filed in court regarding this issue if due is not cleared soon.Whats going to be the course of law n what should be our stand ??if my grandpa has some immovable property in his name at the address,can it be confiscated for settlement....can we file a case on our ground of being cheated by privately employed agents of bank who didn't make us understand all the terms of bank clearly..and issued the credit to a person who is almost illiterate..??

Dear friends,
A Sick Industrial Company had prepared a Draft Rehabilitation Scheme (DRS) and presented it before BIFR for its approval. An unsecured creditor filed and application before BIFR requiring that Company had not incorporated its dues in the said DRS and accordingly the said DRS has to be declared as incomplete and a fresh DRS should be filed by the Company with incorporating of theirs dues.
Friends, let me know that whether unsecured creditors have right for any such types of application or can BIFR pass a declaratory order that contention of unsecured creditors is right and directed to company to file new DRS with incorporating dues of unsecured creditors.
Please share yours view with supporting of landmark case laws.
