An agreement was entered by a company and an individual in the year 2005 containing an arbitration cause. However the company recd its certificate of incorporation in 2006. Can it be said that there was an arbitration agreement between the parties.

1. We want to remit funds for filing return for the LLC company incorportaed in USA. whether any permission require from RBI.
2. Do we need to acquire a permission for incorporating a Company in U>K.We also want o acquire the shares in the Company and become one of the Director there
2. Also we want to establish a college in Dubai. Whether the investmnet there require any permission from RBi or govt.

would like to know the procedure for forecloseure of the mortgage? A person has mortgaged (registered) his land to my father. We would like to foreclose the deal.
Is the SARFAESI Act applicable to a registered private money lender ?

Dear Expert,
We have two seperate manufacturing Units, having seperate Excise Registration, but common Company Name, Common VAT No. & Common Balance Sheet (Though seperate accounts are maintained).
SSI Rules provide that Investment in Plant Machinery should be below 5 Crores for eligibility of Small Scale Unit.
Question : Will the investment of both units be combined to decide if it is SSI unit. ?

i hv taken the cc loan from SBI in 2oo7. IN 2010 A/C has became NPA but no information has been passed to me by the bank . suddenly demand notice has been issued for RS. 401558/-. possession notice has been also issued but no date mentioned and no published in the news paper within seven days .After that i went to bank and one lac deposit in my cc A/C on date 22-10-2011 BY the order of bank manager. 31st july 2013 auction notice has been published in news paper for RS.470382/- . Auction date 13 September 2013. then iwent bank but no agree for settlement and told me one lac deposited amount and FD amount for RS. 40000/- has become nil. you wil hv to deposit 470382 . HOW TO STAY AUCTION PROCEEDING ? AT THE TIME OF SETTLEMENT HOW TO RECOVER DEPOSITED RS. ONE LAC & RS. 40000/- FD Amount?? AND HOW TO SETTLE THE LOAN? THANKS KINDLY GUIDE ME

I have two very simple questions.
1.In business contracts can we use the word 'penalty' for non performance of contracts?
2.Is the word 'penalty' reserved for use only by the state administration or the judiciary ?
