To Pradeep sir,
Sir whether can suit for gratuity if central govt employee not getting gratuity even after 15 year of service whereas in private or public sector qualify in service is five year and he or she is eligible for gratuity….is it not a clear case of error in two different law becoz gratuity is a honour which has to be given by employer ? Apart this in same case if a central govt employee give technical resignation and absorbed in PSU or in state govt and than if he gives resign he becomes eligible for gratuity to take from his previous employer if more than five year he did served???? it is totally contradictory??
Kindly clarify sir… whether ground is available to file a suit on above case for gratuity???
Regards

Respected Sir,
With reference to above subject, kindly note that the husband of the widow is passed away on 25.11.2022, in Mumbai After a written request to Housing Society by the widow to transfer the entitlement of flat from her deceased husband to her name, the governing body expressed their incapacity of doing so for want of special order conferring them the power to carry necessary procedure to transfer the ownership of flat from her deceased husband to her. When MHADA SRA office bearer said that it is to be done at society level and no special letter instructing society to carry out transfer is possible. They had given the reference of MHADA circular No.152 issued at 5th June 2015. As per the plain reading of the circular what can be understood is that the husband and wife are naturally join owner of MHADA SRA flat even if Husband's name only appears in Annexure 2 of MHADA SRA Allotment Letter. Please advice what step to be taken to move the society Governing Council to transfer the flat from Deceased husband to Widow? Thanks
Should Children of the widow make any disclaimer on bond paper?
Please advice.

Execution of dv maintenance order
Hello experts,
My brother's wife HAD filed DV case against him. The trial court ordered to pay Rs 3000/- per month to her. We appealed the order and (even she appealed it.). The sessions court upheld the trial court's judgement. It was solely on the basis of my brother's job before the court cases.
My brother is a patient of Paranoid Schizophrenia. His psychiatrist has recorded his say in the court. The court has admitted that my brother is a patient of Paranoid Schizophrenia. The court has also admitted that there is no property that belongs to my brother and also No income from any ancestral property.
But my brother is not in job and he says he will not pay any money to her.
What action the court can take on my brother if he fails to pay the maintenance?
