Email from an advocate or not

Dear members,

Thank you all for the portal.

One of my colleague received an email which was regarding his financial dues. The email read that they have sent arbitration and even impound of passport. But the email did not have any specific information related to the financial dues such as credit card number or loan number. It was just stating that the case shall be filed. I read the email myself and it was true. It only had the contact number of the advocate and he had asked my colleague to contact to amicably settle things outside court. All our friends just left it and paid no attention.

Today again he received another email with the "same email content" but with different email address and phone number.

Now our colleague is really confused and confused. How could he check if the person who sent email is genuine advocate or not? We suggested him not to respond to the email and it might be fake. Because one of our friend told that banks write off the defaulters due after a period of time and few people inside share details of such defaulters with collection agencies and do such activities under the table. Is this all true? All of us are confused.

He is one of the most humorous person in our batch and we find it difficult to see him all the time with long face. I'll pass on any ideas that you experts give us.

Thank you once again.

What if plaintiff or his advocate does not remain present for a case for long duration.

What if plaintiff and his advocate does NOT remain present for any of the court dates for more than 2 years for a case file agaist a property. Plaintiff filed case and later after 1 year came back to court with an application asking for next date from court. Later plaintiff did not came back, niether his advocate and now Judge is also not dismissing the case. Court has also sent a letter to plaintiff to come in court, but still niether plaintiff nor his advocate has came to court. As a defendent, what all rules can be used to get this court dismissed as early as possible. As intention of plaintiff was only to trouble and harrase defendent. This case is at Taluka level court. Please advice me, Thanks in advance !!

Electricity

My Father (40%)and his brother (60%) are joint owners of a residential flat. The electricity connection is in the name of the builder as the builder had not transfered conveyance in the name of the society since building it. There is a dispute over electricity usage in the premises we reside. Currently our electricity suppliers is Reliance.

Query: I would like to know the procedure to change the supplier from reliance to TATA, and whether we can face any obstruction from my uncle who is the joint owner of the property. Also, is it possible to get a fresh connection from TATA in the name of my father, and continue the current connection from Reliance (which is in the name of the builder) for use by my uncle?

A miscellaneous query related to consumer protection act...

Firstly Let me introduce myself, I am Siddharth Dubey from Bilaspur city,Chhattisgarh State..
My Father and Mother Both are Advocate by profession.
SIR actually matter is that my mother and father are practicing in high court of chattisgarh, bilaspur.

one petitioner has given a case to my mother .initially he made affidavit in front of oath commissioner for his own WP (criminal ) matter.

as a result my mother filed an WP (criminal) and also a suit for declaration and injunction before the civil court against the respondents B.

Thereafter petitioner changed his attitude and denied that he has not given any power (vakalatanama) regarding the above said case & he also denies filing of any petition before the said court. When my mother appeared in the civil court , petitioner denied and engaged another counsel regarding he same . before the civil judge class iv ,matter was heard in absence of said petitioner and newly engaged counsel as a result, court dismissed the petition due to non appearance.

Now after few days petitioner of the above said case filed a complaint under section 200 before JMFC, that we have taken money 25,50,000/- RS for the court fees and we have not filed the case suit,in addition to complaint it is pertinent to mention that petitioner told in their complain that they have drawn the amount by self cheque but in police complain they told about cash payment to us.

in police investigation it is mentioned that cheque is drawn as self cheque by
the petitioners itself.

but now JMFC has registered section 420,467,468-34 of IPC and summoned. We moved to district and session judge, our revision was dismissed,we moved a wp u/s 227 which was also decided in our disfavour…finally we moved an slp ,we got stay against the subordinate order and our slp was granted and converted into criminal appeal…
Interestingly that client has approached state consumer disputes redressal commission and filed a complaint under section 17 of consumer protection act,1986 demanding the amount which was said to be given to advocates.please suggest me a relevant remedy and citations in view of above circumstances…..
