THE HON'BLE HIGH COURT DISPOSED OFF A CASE RELATING TO THE ORDER OF DRT APPELLATE TRIBUNAL IN DISMISSING THE APPEAL FILED BY A GURANTEER. IN THE ORDERDTD.09.08.2011 PASSED IN THE PRESENCE OF THE COUNSELS OF BOTH SIDE, THE HON'BLE HIGH COURT SET ASIDE THE ORDER OF DISMISSAL WITH A DIRECTION TO BOTH SIDE TO APPEAR BEFORE APPELLATE TRIBUNAL ON 29.04.2011, ON WHICH DATE THE APPELATE TRIBUNAL SHALL FIX A DATE FOR FINAL HEARING OF THE APPEAL.IN THIS CONTEXT AND WHEN THE GURANTEER/ APPELLANT HAS NOT RECIEVED THE CERTIFIED COPY OF THE ORDER OF THE HON'BLE HIGH COURT IS IT LEGAL ON THE PART OF THE BANK ADVOCATE TO SEND A LEGAL NOTICE ON16.08.2011 TO THE GURANTEER EVEN ASSUMING THAT, THE BANK HAD INSTRUCTED HIM TO DO SO SPECIALLY WHEN THE ORDER OF THE HON'BLE HIGH COURT IS PASSED IN HIS PRESENCE. WHAT SHOULD BE THE LEGAL OBLIGATION OF THE ADVOCATE OF THE BANK IN SUCH A PECULIAR SITUATION?

sir, i am from coimbatore.my tenant had his agreement on june 2011 for 2yrs. now he is creating troubles and dnt pay the rents for august month . he is not allowing any other person to occupy my another premises, now is is asking compensation of 5lakhs to vacate my premses.,what do i do to vacate him .

Sir,
1. In 1999 i have availed term loan from CENTRAL BANK OF INDIA for 75,000/- under self employment scheme for PRE-PRESS UNIT. Repayed it on 2002.
2. In 2003 - PMRY loan for 1,75,000 was sanctioned by the same bank for establishing OFFSET PRINTING machinery. My fathers propery (a vaccant site 2400 sq.ft) valued by FIV for 200/ per sft. was attached and my father (VRS staff from State Bank of India) was guarantor.
The loan period was 7years 2003 - 2010
a. The loan slipped to NPA by 2004. for 1,56,000/-
b. The Bank did not seize my offset machinery.
c. The bank did not sue me.
d. The bank auctioned my fathers property (guarantor) to a throw away price. (1,55,000) at 2005 itself. Bank sent me sale notice. Sold it below my NPA.
c. Buyer was solo - no competion. he gotit easily.
d. My father in this grief died.
After 7 years bank issues me notice that there is a arrears of 14000/- and special OTS offer for 7000. What should I do now. The sold property's then value was 250/- per Sft. Present value is 2000/- per Sft.
Is bank wrong - in Issuing me PMRY loan after giving me Self Employment loan - Pledging a vaccant site - Asking gurantor for issuing PMRY loan. (have they followed all RBI guidelines)
Is there any chance to get my fathers propery back. I am ready to repay the NPA amount also.

Hello,some of my competitors and ex-employees have posted false & defamatory remarks about my company in various complaint sites.Most of the complaints are posted with fake names or anonymously. I filed a complaint with the cyber cell & contacted the webmasters to remove the postings after sending them a copy of the complaint. But the site owners refused to do so. Some even asked for a huge sum to remove the postings.I have a small business & I cannot afford paying a large amount for online reputation management services or to pay the webmasters the kind of amount they are demanding.I dont know what to do as I'm loosing business & reputation.Please suggest a remedy. If it requires an order from the court ,please tell what charges a lawyer can ask for?

In the model trust deed of a charitable it has been mentioned as "(Party of the first part) hereinafter called " SETTLOR OF THE TRUST". Who could b this first party? the Government? the Public? Or someone else?
