Mediation and Conciliation

Respected Sir/Madam

We have Arbitration and conciliation Act 1996. In that provisions for conciliation are given. But there is doubt in my mind relating to concepts of Mediation and Conciliation. Mediation has not been defined in the Act. In both these methods 3rd party participates in dispute between parties. But what is the exact difference between Mediation and Conciliation?

Thanxing you in advance.

Housing Co-op Bye Laws

While adopting the Bye Laws, the members approved a small amendment to Bye Law No.69((iii) by adding a sentence: “ Expenses on repairs and maintenance of Common Areas and Facilities as defined in sub-clause (xxii) of Bye Law 3 shall be borne equally by all members”, which is just clarificatory in nature.

Some members are taking exception to the above amendment on the plea that it does not conform to the Co-op. Laws and that even model bye laws are silent on it. Common Areas and Facilities are for the benefit and enjoyment of the members equally, irrespective of area of the flats. Naturally, the cost of maintenance has to be apportioned equally to all members. If not, it will create disparity in apportionment of charges. Can anyone clarify whether the amendment carried out is proper or not!!

Society Matter

Dear Sirs,

Our CHS situated at mumbai having 53 members. One person has sticked to the post of secretary since 1997. Last election of the society was held in 2001 and it's term were expired in 2004. After 2004, out of 7 committee members, 5 have resigned and 2 remain in the committee. There after no election has been held till now and the bank account has been jointly operated by the said secretary and other committee member till now. However, from 1/4/2011, the other committee member has also resigned from the committee and our committee now consist of only one person in spite of seven. The main problem now is that our society can not make any payment for any purpose including electricity bills, water bills, watchmen salaries, property tax etc. as there is no second signatory in the cheque and there is a need for atlest signature of two committee member on the cheque. There is a complete possibilities that in coming days/weeks, there may be a shut dowm of water supply, electricity supply etc. to the society. However, secretary is not worried about it. Further, the said secretary is now not a member of the society since January 2008 as he has transfered his flat to his son by gift deed.

What precautionary measure can we take to avoid such disruption of services or in case of disruption take place in our society. Can we lodge a police complaint in this regard or is there any other steps for which we are eligible for?

Please advise.

Thanks.
