Negotiable Instruments Act


A cheque is dishonoured for insufficient funds and the notice of dishonour has not been sent with the statutory period as required under the Act. In order to avail the recourse of filing complaint under 138 can the dishonoured cheque be represented again to obtain a cheque return memo and then serve a notice of dishonour within the validity period. Is there any case law of the Apex Court against it??

Case filed in Mahsul sachiv Amdavad

A Farming Land was converted in Non agriculture and permitted for construction. I filed a case against that order done by DDO Anand that there was elegal steps were taken to pass that order. The case was filed in April 2010 but not any date come out even after 5 months time. I also heard that they take long long time to run the case. I am NRI and how long can I wait. Plus when I will be back home it may come to run thwe cAse so this is very critical issue for me. Pl. help me. what to do and how.

car park

I am proposing to buy a ten years old flat in chennai. The builder's agreement entered with the previous owner reads that the building maintenace will be only with the builder, he has the right to extend and use the vacant land including terrace . the builder also owns a floor for his use.though the agreement says about the uncovered reserved car park, as the original owner was not using the car park so far now he says that I have to buy the car park if I want. as per the legal opinion the lawer says but for this the title is good, and it is upto me to decide. Kindly advice whther it is safe for me to proceed further.

RTI

My friend in Mumbai is in the last year of 5 Year BLS. He appeared for the first semester. After results in one of the subject, he is shown as absent. The college record which had centre shows as Present. The University not providing any details. He has filed an application under RTI. More than 90 days have gone by the University has not reverted. He tried taking copy of the attendance for that subject from the College, but the college refused saying that they will provide copy of the attendance when they receive direction from University to do so. His year will go wasted because of negligence of University. What can he do further. kindly help...with proper directions.
