long term capital gain tax

Hello Experts ,
My father and mother booked a plot worth 60 lakhs with a builder/developer under construction/development linked plan in july 2009.My father made part payment for 10 lakhs & 10 lakhs from relative (Total 20 lakhs). In feb 2010 my mother sold a plot for 10 lakhs and invested the amount in the above mentioned plot. Now my father wishes to sell his 15 yrs old plot for 40 lakhs , pay the relative 10 lakhs and rest to the builder to cover the balance . the builder is expected to do the registration / possession by april 2012.Then we plan to construct the house.
My ques is Is my mothers plot sale & fathers plot sale long term capital gain are adjustable in this booked property.

REgistration u/s.12AA of the Act

Whether a charitable trust or society seeking resitration u/s.12AA of the Incometax Act should invariably possess a registration certificate from the Charity Commissioner/Endowments Commissioner of the State Government? Is it a requirement of law as per the Biharilal Jaiswal judgement of the Hon'ble Supreme Court? What is the impact of the judgement of the Hon'ble AP High Court in the case of New Noble?

consequences of late filing of 15J, 15G and 15I forms before CIT

Whether the belated submission of forms in 15J, 15G and 15I before the Commissioner of Income-Tax would attract the provisions of section 40(a)(ia) of the Act? What are the consequences of late filing of such forms before the CIT. Any case laws please.

Income tax on NRI

Are the Foreignors/NRIs eligible for refund of tax deducted by the bankers on thier Fixed deposits.
These Foreignors/NRIs are having PAN cards, but they are not staying more than 180 days in India.

Is Sec.80G applicable on LT Capital Gain


Learned Experts kind opinion is requested in the following case.
One of my friend of Age 55 years has sold his flat at N.Delhi & got Long Term Capital Gain of Rs. 1.20 Crores in Oct2010 out of which he has purchased dwelling house costing Rs.1.15 Crores. From the balance Rs.5 Lakhs he has made donation of Rs.4 Lakhs which is exempted U/S 80 G of I.T Act. He has no other income. My question is
1) Will his donation of Rs.4 Lakhs u/s 80G be rebated from his balance of Capital Gain of Rs.5 Lakhs (i.e. after purchasing house for Rs.1.15 Crore out of LTCG of Rs.1.20 Crore) while computing his tax burden?
2) Is exemption u/s 80G applicable on the net total income including LTCG or all other income excluding LTCG?

Can a settler in a public Charitable Trust allow his premises to be used for office of Trust.

At the point of Registration of a Public Charitable Trust u/s 12AA & 80G of the ITAct 1961 , the Commissioner of IT refused to register the Trust on the ground that the Settler has allowed a part of a premises owned by him to run the Registered office of the Trust which affect the irrevocably clause of the Trust and still the settler has control over the Fund

conversion of proprietorship into partnership firm

I am having a proprietor ship firm in Delhi. Now I wish to convert this proprietor ship firm into partnership firm. Is it possible? Should we apply fresh registration under DVAT, Excise and fresh TAN and PAN number for new partnership. Please advise.

spread over of vrs benefits

I opted for VRS in April 2010 from MMTC, a Govt of India public Sector Corporation, my superannuation/retirement is August 2014 and VRS amount calculation worked out to Rs 25,00,000/-. After allowing exemption of Rs 5,00,000/- (Rupees Five lacs), rest of the amount has been subject to TDS @ 30%. I want to avail the benefit of spread over of VRS benefits
I am unable to spread over the amount
