I bought flat in redeveloped building in 2013, which got OC, and i got possession in May 2014. building has conveyance.In July 2016 builder started the process of getting us added as member in the same old society and not forming new society.Old society as it is will continue and their MC members.
MC term was expired in Jan 2016 and they applied with registrar for election as per new bylaws now on 18th July 2016. no updation or action by sub-registrar yet for election.
In the mean time 2 SGM are been called by the MC for structuring of maintenance and adding new purchaser as society member. Society Membership forms been submitted to MC in Aug 2016 and MC added new 14 member & resolution was passed in 21st Aug 2016 in one of the SGM.
However now the Secretary has purposely misplaced our membership application forms of 14 new members so as to delay the membership. We are opposing the illegal structural changes done by the MC and other old members of the society since last 2 years. they are affraid of our escallation complaint to registrar post adding member.we have written complaint letters sent to MC.
Now oct 2016 onwards we got the maintenance bill. we are decided not to pay the bill as we are demanding the new amended by-laws approved and implemented which they are delaying for action by way of penalty under by-laws no 159 or 160 that 5 times of the maintenance charges.
If we pay the bill,whether that implies that society has accepted our membership even though forms are misplaced and other formalities are incomplete? pls suggest
can we still demand for the penal action even though society has not approved & implemented the amended by-laws no 159?
can we still escalate the matter with sub-registrar about the irrgularities of the Managing Committee?
Kindly suggest.

sir,
i heard from a seller that we cannot register unapproved land in chennai a law is passed.The result is on 22 oct 2016.till then we cant register any unapproved land?is it true?

sir,I have purchased a commercial space wide registered agreement to sell paid full consideration amount in advance but after completion of building builder did not informed me in writing about the completion of the building neighter informed me about the possession nor about the execution of sale deed as stated in the clause 4&5 of the registered agreement to sell..and he without my consent rent out my alloted premises to ciet tyers..sir,plz suggest me what to do.
X Who is muslim by religion having his self acquired property.
X has 4 sons & 3 daughters.No wife alive.
In 2001 he made Notarised i.e.unregistered HIBA of his 1/3 rd property to Son-I and also distributed remaining property to 3 sons & 3 daughter equally.
Query.
1) Can other legal heirs ( 3 sons & 3 daughter) can have share in this gifted property?
2)In 2016 Son II now say that he had also gift in their favour made by his father.
Whether is is valid? since it is made with out consent of son I.
3) Son I had possession of property since 2001 & have names incorporated in 7/12 extract & paying the land revenue , municipality tax since then. Whether he can go for suit for declaration or cancellation of HIBA Or take legal heir ship certificate from the court to prove that he is the only legal owner of that gifted property?

My name is mehboob alam.i am Muslim My great uncle die unmarried(no wife no child) and my grand father was dead my grand mother died.my grand mother have two child.my father was dead . my mother have six children (one female and other male). .my uncle have a wife with three children. my great uncle have no will. and grand mother have no will.distribute the property among them.(Ancestral property)

ONE BUILDING OF GROUND AND 18 FLOORS HAS BEEN CONSTRUCTED IN 1982 BY A BUILDER IN POSH AREA OF BOMBAY. HE HAVE TAKEN A BIG AMOUNT AS DEPOSIT AND ADVANCE FROM SOCIETY. HE HAVE NOT RETURNED THE SAID AMOUNT TILL DATE THOUGH HE OWNS A FLAT IN THE NAME OF HIS WIFE, HIMSELF AND HIS SON. HE HAVE ALSO NOT EXECUTED ANY CONVEYANCE OF THE PROPERTY IN THE NAME OF SOCIETY.
ANY ACTION CAN BE TAKEN AGAINST HIM FOR RECOVER THE ADVANCES TAKEN BY HIM.
WHETHER HE AND/OR HIS FAMILY MEMBER CAN STOOD OR APPLY FOR MANAGING COMMITTEE MEMBER.
ANY ACTION CAN BE TAKEN IN COURT FOR NOT EXECUTING CONVEYANCE OF PROPERTY IN THE NAME OF SOCIETY IF YES WHAT ACTION CAN BE TAKEN.

Respected Sir,we have traced now 70 years old my grandfather purchased sale deed of 4 Acres revenue land, now the land in the possession of others and they are forming, all the years we don't now this deed, we can claim

Respected sir...i purchased a house on court agreement as registry is banned in cantonment area by govt 4 yr back.... she purchased this house in 1998 through legal sale deed registry... now a nri given police complaint against both of us of illegal occuping his house...police giv us clean chit of no forgery as this is civil nature case in its report.. nri claimed that it was his father house and other brother didnt giv his share while selling.. still nri didnt move in court but wat should i do to get rid of this problem..nri has no paper to prove his part ...police enuiry revealed that house was once transferred in his father name in land record in 1995....thereafter land record shows change of owner two tyms. And tax is also not of his father name....plz guide me...thanx
Purchase of commercial property (shop) from builder
Hi.. I am planning to purchase a shop from the builder in a newly constructed residential cum commercial building in Navi Mumbai.
I would like to know what are the precautions to be taken and what documents are required to be checked. Also whether there are any statutory compliance requirements under Shops & Establishment Act. I will be giving it on rent. Hence, I presume there will be no Labour law requirements. Please advise.
