Kindly give your valuable opinion on the following legal issue:
Grand father has some property of land and house. He has 5 daughters and 3 sons and he died in 1982 without any will or distribution of his property. Grand mother also died subsequently in 1985. Property is still in his name and tax payments also being made on his name only till date. Out of 3 sons and 5 daughters, one son died, but his wife and his children (3 sons - all married) alive. Elder son had taken part of land to meet his immediate requirement in 1980 itself and verbally informed that he will not claim any share in the remaining property. Now, one his sons wanted to have the property distributed among other 2 sons and 5 daughters. How to go about it for appropriate sharing among 2 sons and 5 daughters. Kindly guide us in this regard. What is the status of a "NOMINEE",now-, in a co-operative house building society, in the light of Supreme Court judgement in Civil Appeal 4646 of 2006 between Indrani Wahi and Sarbar View Co-operative Housing Society dated March 10, 2016 ?And what is the fate of nominees who have been termed as "trustees" and not given their rights in a number of earlier cases. Can those who lost their rightful assets earlier demand their rights now in a court of law quoting the above cited SC judgement.Please throw some light on the exact meaning of "that the rights of others on account of an inheritance or succession is a suservient right". --Please clarify and guide us as to how to go about in such cases unresolved and still pending in different courts including Supreme Court.

Rohtas is developing township at sultanpur road Lucknow. The project contains gram sabha land. Developer is saying that such land with the concurrence of Lucknow Development Authority is sold by the concerned govt authorities to the developer at the prevailing circle rate. I want to know from experts whether Gram Sabha Land can be sold by Govt to developer if the land is coming in the overall circumference of the DPR of the project submitted by the developer.

I am having a flat in my name and ownership. Since I am planning to let out this flat I fear income tax on it. Already I am salaried and falls in highest tax bracket.
I want to enter into a gift deed with my wife where I gift this flat to her and then let it out.
By this way I think I can save some tax as well as my can show some good amount of white money in my wife's name.
Please advice.

Hi, recently, I took a property in which I added my mother as my coapplicant in the sale agreement.
Now my Pf withdrawal got rejected because they have a clause in which the agreement should be either solely on my name or on my and my spouse name.
Please suggest some way in which I can withdraw the amount . my mom is happy to transfer all her ownership to me.

my family has a house in mumbai. The house comes under pagdi system. The house is in the name of grandmother. My grandmother died on 20 sept 16.
The landlord lives in same locality of our house.
My grandmother had 3 children- my dad the eldest, my uncle the middle one & youngest my aunt.
The landlord of the house has sold the room for 18 lakhs without informing my dad. My uncle & aunt are on the side of landlord.They both got 4 lakhs each for signing the NOC of the property. Now the landlord is pressurizing us to take 2.5 lakhs to sign NOC. We are demanding 4 lakhs but he is not paying.
The room rent for the past 10 years has not been paid. In Previous month we sent 10 years room rent to lanlord by money order which he rejected.
Now the landlord says that even if we file the case in court can landlord win on grounds of 10 years room rent not paid.?
Secondly he has sold the entire room without our sign on NOC. Please advice can we win the case on this grounds.? If we go to court can we get the entire property transferred on my dads name.?

Hi, in 1989,on the property of my father in village someone by showing fake documents has wrongly entered his name as a legal heir of property & now as on 2017 his name is appearing on 7/12 extract instead of me the legal heir.
Please suggest me with the procedure to remove the name of illegal heir.

sir. we have house property on 50 -50 on my father name and elder brother. now my father died living behind no will. no nomination were made.. does it automatically tranferred 50% of my father on my mother name. or any procedure.

i am from thanjavur district was residing in rented house where in we as a tenant made an agreement for address proof purpose now its since three months over we have vacated the house the land lord refuses us to pay the rent advance. what we can do to this kind of issues.....

Stamp duty was not paid by the first Owner on a Mhada flat. Can someone please tell me what is the procedure and how shall I go about it. The flat is in my name and I am the 3rd owner..thanks
