Freehold of dda flat

Dear Learned members,

This is a personal query of one close friend relating to freehold of a DDA flat.

The matter is like this.

My friend purchased an LIG Flat in Delhi under un registered agreement to sell/GPA in 2003 from the second party which he now wants to get freehold from DDA under the relaxed scheme launched by DDA in 2014 for conversion of unregistered ATS into freehold.The said scheme, requires all the agreements to sell after executed 24.09.2001 to be registered from the registrar.I have visted with my friend to the concerned SDM office where the concerned clerk calculted duty @8% on the value of agreement to sell exceuted after 24.09.2001(both are excuted in June 2003)and also told us that there will be a penalty upto 10times of the duty at the discretion of the SDM.But the DDA says that the stamp duty should be paid on circle rate. I told this to SDM office guy, he says the duty will be on the consideration amount mentioned ion the ATS as the circle rate was not applicable then in 2003.We are at a delima who is right whether SDM ofice or DDA guy. But I feel it's a state subject so DDA should not question the duty calculation of the Delhi Govt SDM office.

The second issue is that the DDA guidelines says that the unregistered agreement to sell executed should be registered with the concerned Sub-registrar.The SDM office says that there is no registration involved in this case only the payment of stamp duty which has not been paid earlier will have to be paid. he says that we will have to buy the stamp papers as per the value calculted by SDM which will be signed and stamped by them and that will be the documents which will be submitted to DDA with application and other documents for free hold.I have visited the sub registrar office there one person told us that they do registration of all current documents and all old cases are done by SDM.But we are confused as which one is saying correct.

can anyone please throgh some light on above two issues. Shall be highly grateful so that we donot stuck in DDA office.

sale deed

dear experts
a person taken a loan from X of rs.4,00,000/- and executed a registered sale deed of his plot on a condition that when ever the amount is repaid he has to re execute the register sale deed.but there is no any document on that condition.now the person ready to pay the amount with interest but X is not in a mood to re execute the registerd sale deed.
kindly advice on this .

How many members are required in society committee

Dear Sir,

We have got possession of flats 2 years ago. But still builder did not provide OC & water supply of Grampanchayat. In this case, how we can form society & demand to resolve our issues by Builder.And please let me know how many members are required for society committee.
Pl advice.

Ancestor property

My Grandfather have 6 sons and 3 daughters. He is passed away in 2012. My father is 2nd son and he also passed away in 2007 before my grandpa. For my father two children- myself and my sister. My mother is alive. All the original documents of my grandfather's property is now been in custody with 4th son. He is not giving responsible answers when documents are asked to bring for partition. What is the procedure to get the same and also other 4 sons, 3 daughters are ready for partition, but 1 culprit 4th son is playing games and dragging for some unknown purpose. How to solve this issue quickly.. Please help !!

Registration deed

I had purchased a flat from builder in 2011 and builder got me a home loan from lic of india. Now when the interest slashed I decided to transfer my loan to Tata Capital housing finance. They verified my documents and informed me that the builder had registered this property and later there was a correction and cancellation of the deed of the flat that I purchased . The builder never told me this at the time of purchase and now when I am asking for the original agreement,correction and cancellation documents as asked by Tata capital the builder says that they have brunt the document and no longer have it. The legal team of Tata capital say that the title of the property is not clear unless I have the original. Please suggest what can I do so that I have no legal trouble

Name removal in registry.

I purchased a plot in Lucknow with one of my friend (no blood relationship) but now I want to remove my friend name in the registry so that I can become the sole owner of the property. What will be the procedure for this.

How many members are required for society formation

Dear Sir,

We have 5 buildings of 170 flats in our complex and we want different societies for every building. Kindly advice me how many members are required for society formation & for society committee. Kindly also let me know can we insist our builder to form 5 societies instead of 1 society.

regarding property registration in cash

sir .i have sell one property..buyer makes a registry in which he mention 6.5 lac demand draft and 2.5 lac cash. .i was no aware of the fact that we cant take more than rs 20000 in cash..in the registry itself 2.5 lac is mentioned as cash..will it be a problem for us..
