tenant

My father and his cousin was partner in a firm. The firm they were partner was running from a trust shop. Bhadachitthi of the shop was in name of my fathers cousin. In 1974 they forfeit the partnership. And they make deed in which my fathers cousin left from the firm and give my fathers rights for the shop. They made this deed in 1974 on a 50 rs. Stamp paper which was not notarised by that time. Can someone plz tell me if there couldbe any problem with his validity

House property fakely registered by others

Hello sir,
My father and his three brothers having disputes regarding assets of the joint family.As per the decision of my grand father one of the house property has to be registered under my father name but my grand father passed away then taking this as opportunity by my uncles (3 brothers) have registered that house property to others.My grand father signed the unregistered will even it's plain then they have managed these as the source. In that it is shown that the property was gifted to one of my uncles son by taking this they sold the property to others.Later they came to compromise and they are saying that us to execute a sale deed and then it will be in our name.But as per income tax when ever the sale deed executed they will ask for the source of funds it will be problem to us and whenever we sale it will attract capital gains tax.We can't face these problems.If it's actually registered under our name as per partition of the family and when ever we sell we will pay capital gain tax but here they want us to purchase not really (as per documents) and sale the property.Please guide me with correct solution.

Vacating relatives from my owned house

The property belongs to my father, he is the sole owner of the property. While buying the property, we were not in that city. For time being we kept my dad's family(including my dad's 3 brothers and their families along with grand parents) as tenants ( there is no letter or agreement made tat time for tenant formAlities since they are relatives). When we came back to the city, we asked our uncles except grandparents vacate the house since my family has to occupy the property.. also gave them few months time during tat periods grandfather and uncles filed case against my father asking for partition in that property. In additional court judgement passed infavour for my father since they never contributed anything for the property also that property bought only in housing loan that is getting debit from my father salary. Again they appealed in high court.. there also Case dismissed. In mean time they are threatening us with political people and local rowdies to register that property in their name. After the judgment s also they are doing same thing by occupy if position in that property. I need suggestion that whether we can give complaints to leave can police station or not also local police people are supporting them. We are planning to put eviction. How long it will take to vacate if we do so.? Is there any possibility for them to appeal against us in court?

Leave and licence agreement

I reside in bangalore. I am renting out portion of my house. I do not want to embroil legal difficulties if tenant is bad and he does not vacate after expiry of agreement. Does lease and licence agreement help me to get eviction order from court in short period? Is registration required for licence period of 11 months?
Kindly clarify , I had bad experience with tenants in the past.

Real estate

when builder follow the completion method for each project on consistency basis , and project is completed only O.c. is under process to release to builder , and mostly 85% flats are sold, one of the flat is sold on the basis of the letter of allotment but agreement for sale and stamp duty is yet to paid , can receipt of advance to be considered as sale ? under which basis so ?

Rights & liabilities over jointly possessed property obtained against finance

Greetings Respected Seniors

Facts:
I along with my brother in law have conjointly provided loans to a person (Borrower) to the tune of Rs. 3,40,00,000 /- (Rupees Two Crores Forty Lacs Only) (Said loan) in equal proportion i.e. Rs. 1,70,00,000 /- each. However due to poor financial conditions, the said borrower is unable to repay the said loan to us. The said borrower is owner of a 3 BHK Residential Apartment whose approximate market value is about Rs. 6,00,00,000 /- (Rupees Six Crore Only). Since the said borrower is unable to repay the said loan to us and also since there is no potential purchaser of his “said flat premises” in the present market scenario, therefore the said borrower has now agreed to grant possession of his 3 BHK owned Flat premises to us pursuant to the execution of one “Memorandum of Understanding” which particularly stipulates that we (I & my brother in law) shall take possession of his said flat premises for a period of 6 months. During this phase of 6 months, we shall try to market & sell the said premises to a third-party or in the alternative I alone shall purchase the said property at market rate from the said borrower, in case, I desire to do so.

Query:
During this phase of 6 months wherein the said flat premises is in our possession, my queries are:
1. What are the rights and liabilities of each one of us i.e. Me & my brother in law in respect of the said 3 BHK flat premises during this phase of 6 months?
2. If I intend to take a trial of the said 3 BHK apartment by residing in it on trial basis (In order to decide if I wish to purchase the said flat premises from the said borrower), then what is the duration for which I can personally reside in the said flat premises (on trial basis)? Does my partner i.e. my brother in law has a right to take an objection against me for residing in the said premises on trial basis for a fixed duration?

Kindly enlighten me on this captioned matter.

Builder going against the Agreement

I want to seek your advice on how to file a case against the builder for stopping pre EMIs under subvention scheme. I have a written agreement with builder where builder have to pay the pre EMIs till offer of possession however builder sent a letter which is a intimation of letter of possession. When I asked builder why they stopped the EMIs then builder asking to assume intimation letter as possession letter. Which is a cheap trick. They don't have CC so can't offer possession however they tricked buyer with the intimation.
