Huf property

My question. Property is in the name of vimal Jain huf he has 4 sons In 2010 with agreement with his coparsenors he has transferred the property to his elder son. Now after the death of his elder son he wants to file a suite stating this property got transfered without my concern. Can he file the suite or he need other coparsnors permission

Registration and stamu duty charges

Hi Sir/madam,

I have a property (Shop) of 300 sqft Buildup area for which I need to pay the registration and stamp duty charges.My consultant told me to pay these charges on super buildup rate so that I need to pay charges on 240 sqft area and will get benefit of 20% as per govt rules.

Thus, I want to know whether it impact on my original area while reconstruction of my building or not.Or should I pay these charges on buildup area?

Land dispute

Dear Experts,

Recently, I bought 2200 SQ FT land property (DTCP approved in 1992) that was previously disputed by neighbor and resolved in local civil court.

The property went through the following facts:

1) In 2008, Neighbor broke boundary wall built by pervious owner, filed a petition in court that he owns some (560 SQ FT) of the property, as per his registration document, he bought his property in 2002 with attached hand written site layout plan (which are incorrect as per actual Municipality layout plan).

2) March 2017, Court verified municipality layout plan, surveyor report, disposed case as "Uncontested and DISMISSED WITH COSTS".

He came to know that new owners brought the property, he intruded, broke our new boundary wall overnight without court order and plotted layout marking stones as per his document. I certainly do have proper valid registration documents, DTCP approved layout plan and GOVT surveyor report.

Please advice,

1) If i can file criminal case legally as he violated judgement made by local civil court?
2) How can i quickly resolve this dispute? Remedies?

Need completion certificate for our flat. 20 year old constr

Hello Sir/madam
We own a flat in an almost 20 year + old society.
We purchased the flat almost 12 years ago as second buyers, had availed bank loan against it.
We have every other essential document with respect to ownership. However the completion certificate is missing.
Society is taking like forever to process the same. Thus want to process it on our own for our flat.
We are planning to sell the flat, but banks these days need a completion certificate for processing loan, thus unable to sell as prospective buyers definitely seek for home loan.
Please help.

To get hearship certificate i required to pay a court fee

Dear Sir/Mam,
I am staying at Airoli (Navi Mumbai). My father own a house at Airoli. Now my is expired in the month of Nov-2015. I have applied for the Legal Hearship Certificate in Belapur court. I Have One Brother & One Sister. They did not have any objection. I have received the Order copy from the court to issue the Hearship Certificate. To get the Hearship Certificate from the court did i want to pay a Court Fee. this propety belongs to father. Please guide me. Waiting for the positive reply.

3/9 mismatch

Hi All,

Thanks for all your support to the social. I have a query like a property which was settled as a compromise between my wife and his brother via court decree;however, when we enquired on Khata transfer to my wife name for her share, the related officers saying that the property has 3/9 mismatch so it is difficult to survey and sale the property.

Please advise the process to clear 3/9 mismatch. Also there is a case in court on that property which was raised by my wife's father's sister (who's age is moe than 60 years and also the property was given to my father inlaw (my wife's father) by his uncle not from his father ( not from my wife's grandfather).

Please advise how to deal with this. All your guidance would be very supportive for us.

Recovery of money and cancellation of sale deed

Dear Sirs,

I had filed OS against the accused/defendants for cheating / illegal sale of plot in a privately developed layout.

Now the court has posted the hearing for Order state. When the judge pronounces the order in favor of us/Plaintiff would the Judge/Court also help us ensure the defendants are bought to books till they pay the entire money with interest. Also will there be any refund of the court feet paid towards this purpose. Also kindly help me understand once the Orders are passed, will there be any subsequent hearing. if so what are stage and purpose of those hearing. Lastly at what stage of hearing documents i.e Orders OR Judgement documents to be useful or to be produced at the criminal side of the court (district metropolitan magistrate)

I mean does Rooms under Slums are covered under Maharshatra Rent Control Act?
