Ownership of terrace flat

Hi,
we have bought our house in 1999 and we had a terrace attached to our flat.It is a 3 floor building and we stays at 3rd floor with a attached terrace.We have paid rs.75,000 to the builder for the flat and builder has given a document stating that terrace has been sold to us.Also in our sales agreement the terrace portion has been shown assigned in our room's map(signed by builder).There is only on entrance to terrace i,.e from our flat.But in the carpet area section of agreement details onterrace flat is not mentioned.

Q's:

1. Do we need to pay any property tax for this terrace?
2. Do we need to have some legal agreement prepared to be signed by builder or the document stating that this terrace has been sold(& belongs to us) is suffix.

Kindly suggest any legal process (affidavit)is required to be done to be on solid proof as per all ACT's.
Please revert.

landlord and tenant

Thanks to all.

but in 1989, all the chawls i.e. all compound is purchased by the builder named mr. shetty. but some problems taken place between all tenants and builder so the court has given stay that builder will not enter in that compound till the court order. meanwhile builder sold that land to m/s. chetan construction and my clients landlord was not come till 2003. in my clients chawl there are 29 tenants but 15 are already sold their room to the builder.

after that mean time some goondas came and broke the talas of sold rooms and given that rooms for leave and license. that time the landlord was absconded and suddenly from 2003 he came and saying that I am the landlord, he is not giving proper facilities, remaining tenants collects money from their pocket and clean the toilet, Water supply is also not proper.

Agriculture land transfer in non agriculture

Respected sir, I am Ketan Patel and my Agri’ land in Jambusar dist- Bharuch (Gujarat) my query is I want to transfer my land in Residential NA and I want to develop Residential Society, But problem is my land is not in Residential ZONE. So please advise me how I transfer my land in NA and develop Resi’ Society.

Land problem

My grandfather have land in Tamilnadu. After him, his sons had split the land among themselves and registered the partition based on my grandfather's will. Now my father had sold a small portion of land that he had acquired through the partition and had given the money to my sister and planned to give another portion of the land that he had acquired through partition of same size to me. We prepared the gift deed in my favour and requested my sister to sign on the gift deed. My brother in law is not permitting my sister to sign. Can my father transfer the land in gift deed form to me without my sister's signature? and if can, is it possible for my sister or her children claim the land later? Please kindly also advice me on the procedure as we are settled abroad.

Urgently solve

1 My Grand mother is 80 years of age has three sons
2 My Elder uncle
3 My Second Elder uncle
4 My Father

My Grand Mother has piece of land at mahabaleswar\Karjat

My elder uncle going to cheat us by my preparing a will and trying to take all her properties on his name under coercion . he took grandmother to his home since last six month and & does not let her go out side his home

I understand that there is a strong chances of preparing a will without informing us

1 )What are the remedies available to others ?
2) what preventive action we cant take so Thanks in advance

property tax

I am living in south Mumbai in Redevelop multistoried building. On the time of redevelopment builder done stamp duty & registration for all old tenant & give the promise verbally that I am
Taking care of all building maintenance like( electricity, housekeeping, security water bill etc)
With Property tax till O.C & B.C.C (occupy certificate & Building completion certificate) pass or come From B.M.C or MHADA till nw above mention O.C & B.C.C Certificate not cum or pass from MHADA & BMC.
Now builder is not paid property tax last 5year & asking the old tenant to paid the property tax
So placed tell me what to do.

minor interest

Hi learned Advocates,

Clarify this please,

1. the property is ancestral property and two sons and daughters and their minor 2+2+2 are sold the property infavour of "A" on 2005(Ex.,minors age only below 10 ). For their minors natural guardians (father/Mother) signed in the sale deed as a guardians.

2. after that property owner "A" sold to another person"B" on 2006.

3. now what about minor interest?

4. "B" what to get the loan from Bank?
what is the risk?

5. I want to clarify whether minor can question after attaining majority ?

Hindu daughter's right in partnership firm/ pvt,ltd company

sir
my father started a partnership firm with joint family fund with family
members that is his brothers as partners, in the year 1968, we belong to
hindu religion, and another company as pravite limited company in the year
1984 with same family members as directores.It contuned till 1987 after that
my father brothers relinquesed thear right in favour of my father, since
they wear companseated with other business started with joint funds.At the
same year 1987 he made his two sons as partners and directores.he dident
make any gift to us , after in the year 2006 my father got his share in the
joint family property which was sold., my father invested that funds also in
the paqrtnership firm and pravate limited company.It contuned till 2008 my
father died in2008 interstate with out will, in our family we are five
children 2 sons amd 3daughters, all of us are married.
Now my sisters are claiming equle rights in all the propertys. That is the
house property in the name of my father,some funds invested in bank as
F.D in my fathers name,
partnership firm ,and the pvt ltd company.Will the partnership firm and pvt
ltd company also biend to the H.S.A 2005. Sir now the daughter of a hindu
are also equle coparceners,will they get equale right in partnership firm
and pvt ltd company since in was started from joint family fund,and also
joint family fund which was resently invested in the year 2006.Sir please
clear my query.

Sell of property at Kolhapur

Dear Sir,

I have a Flat at Kolhapur. This Flat I have purchased through builder and registration Stamp duty was paid with a Sell Agreement. The Loan from HDFC Bank taken by me and Rs 14 lacs cheque from HFDC bank was given to builder which was handed over by him to his banker M/S Panchaganga Bank at Kolhapur. NOC and Release note for the flat given by Panchanganga Bank. The Original documents are available with HDFC Bank.

Till today the Sell Deed was not made by the Builder. On 24th Nov 2009 we have made Sanchkar Patra with one of the buyer whose son is working with Union bank. This formality was completed by Buyers Lawyer by doing proper notice in news paper. The builders consent is also their at Sanchakar Patra. Then we have entered in Sell agreement with the buyer on 30/12/2009 with builders and my signatures.(Trio party Agreement)

Now the Loan amount of Rs 14 lacs is required to be paid by the Buyer to HDFC
By taking the loan from Union bank. Now two months have passed and buyer has
Not cleared the loan amount which is due. My EMI has been deducted by HDFC bank and I am making loses by paying loan emi.

The Buyer has not taken the loan as he wants again NOC From Panchanga Bank as he found that some loan amount of Bulider on building is still pending from builder. He is always telling me this NOC Reason to get the loan.

Panchangana Bank is not giving any NOC as builder has to pay some loan amount to them. Now the matter is pending from buyer as no fault of mine and I have cleared everything from my side.

Buyer has a fear of Notice which Panchanga bank sent to builder to clear the O/S Loan.

Now I have question whether the Bank will give NOC again which already given by them in the past to me. Also do I need to pay my EMI and if I pay then how and from whom to recover.

How to resolve this issue as in Sanchkar Patra Two Months period was given which was notarized and overdue by @ 2 months.
