Kerala - Flat registration

Hi,

We have just been handed over management of the our apartments (in Trivandrum) by the builder. He wants us to register the flats under the Travancore-Covhim Literary, Scientific and Charitable Societies registration act. Mu understanding is that though the Kerala Government has notified the Kerala Apartment Owners Act in 1984, steps to make it functional have not been taken.
Is this true ? is it not possible for us ?to register under KAOA 1984 ? If yes, who is the competent authority ?

surplus tenement of M.B.R & R. Board
occupied by us.what is that mean.

electricity connection in partition suit case

we are three brothers n are fighting a partition suit of our joint land which our parents didnt divided by their will,i m possesing the property n my brothers have filled the partition suit ,in the mean time they have disconnected my electricity connection and have given an application in the electricity board not to give me electricity connection until the final judgement comes, will i have to live without electricity until the judgement comes, i m in a mess where to appeal, they even threaten to leave the place n go somewhere, pls help me by replying whats the law for this case says

Gift – Father to Son

Can a father gift piece of land (Agricultural land) to his son which is affected by S. 43 of B.T.A.L Act 1948 of Maharashtra?

MUTATION AND SOCITY FORMATION

Dear Expert Sir
We r living in flats under kolkata municipal corporation KMC since 2006.Total 24 flats all have been registered in 2006 and handed over by builder.Builder is having rights of roof under initial agreement.Now 22 flat owners had applied for mutation in Kolkata Municipal Corporation.02 flat Owner did not applied. Builder did not make any arrangment for forming resgistered socity.Builder is not even responding and giving reply to the registered written request. Maintenance of flats is being arranged by flat owners without forming any socity.Even few flat owners are not giving monthely Mainteance Cost.
Now our questions are 1. can KMC issue mutation certificate to flat owners even if 02 flats owners of same plot not apply for mutation.
2. Can we form a register houseing socity without permission and without including Builder as a member.
3. How we can ensure that all members pay mainteance cost.
4. If any member refused to pay mainteance cost what course of action can be taken aganist him and under what law.

jurisdiction bar

The civil court has given me interim injunction against demolition order of dda. But after nearly more than 1 year (more than 2 years have paased now), dda raised objection about jurisdiction of bar of court in the case asking court that case should be dealt in appelate tribunal. It will be cause me further suffering to file the case a fresh in appelate tribunal. Kindly advice remedy.

Laldora Area

Which area is treated as Laldora Area??? Why the Government Authority is not issueing the Approved Building Plan (Maps) for Laldora Area???
What is the Risk in granting / sanctioning the Loan to Laldora Area???
and if there is Ownership Registration in terms of property in the Laldora Area, do that property has Marketable Value for resale, in Banking Legal Terms????

Stamp duty & Court Fee payable

I am petitioning for possession of immovable property being agricultural land. The property was sold for Rs.44/- lakhs in Feb 2008. Out of which Rs.22/- was received in June 2008. The original agreement is with the buyers. In the meantime female members petitioned for their share in the property. The matter is in court. Buyers are also aware of the situation and does not want to cancel the Agreement to Sell deed. Limitation period elapsed as regards buyers. Now, I want to repossess the property by cancelling the deed. How much should I pay as Court fee and stamp duty and on what value.

procedure to get back the property

Sir,

my mother received a gift deed of 2 acres property from my grandmother.1973 our of the 6 acres she was owning in Andra Pradesh . But recently when we got our details from Register office my mothers property and her mothers property are still in theri names only as per the EC records. . Since we had our cousins my motehr had given her property for her bortherin law to growing crops as he had 5 daughter and they had difficult times ( verbally agreed). Yield from the land was taken by him . After his death when my mother went to take custoday of the land. She can to know that he has taken some pass books in his name and given it to two others

How it is tranferred is not know to us since my mother's , borther-in-law has died. When we approach the Tashildhar he told us to come and he will enquiry about the above situtation and we had gone to tashildhars office for meore than 5 times and person whosenames are mentioned in the pass book are not coming to the office ( that is the version of the office staff in the MRO office) and they are not showning us the address of the person who's names are entered and physical the person is not appearing in front of us to show documents.

We met the tashildhar and we had given the details of the property to them and now the tashildhar is saying since it the property of my mother is being forged by my mothers sisters husband and he has created the pass book and sold it two other persons. what should we do now.

kindly advice at the earliest. in andhra how to get the pass books cancelled and some people are advicing to go and contact the district collector and show proofs for benami pass book and get it cancelled. is it true.


So I want to some one to give us good advise how to get back our property. whether we have to go to the court of law or to collector please advice.
