Property dispute

Hi,

My Grandfather purchased some land in 1971 but there was no formal paper work done.He divided the portion in three parts and gave 1 to his elder son and 1 to his second son. In the third portion he was living himself. Since at the time of dividing the youngest son was unmarried so he kept my youngest uncle with himself. There was no formal paper work dividing the land among the three sons. After the death of both my Grandparents, my youngest uncle sold the portion of land in which he was living to someone in village without consulting his brothers. My question is,
1) Since both the seller of land and the buyer of land (my grandfather) are dead, and no paper work was done at the time of sale, who is the owner of land?
2) Is it not mandatory on my uncle's part to ask his brothers first, if they are intersted in buying the land before selling it to third party?
3) What are the options with his brothers to get the land back as for us it is ancestral house and we do not want it to be sold to someone else?

Property dispute


Dear Experts,

I need a opinion about our ancestors property in maharashtra village. The said property was jointly own by my grandfather and his two brothers. My father and my uncle (father's brother)were busy in working mumbai and used to seldom go to village where my father's uncles have been staying for years. My grandfather and his two brothers died long back around 30 to 40 years back. After that my fathers cousins were staying in village and looking after our property. Now my father too is no more in this world but my uncle(father's brother) is alive but paralytic. My father's cousins secretely removed my father and my uncles name from the property card and transferred all the rights to their name in hand in glove with talati.

In such how i should reclaim my property rights. What procedure i should follow.

Land issue

Sir,

I have one small land which is our captured since long time may be from more than 100 years and I made small house there 5 years back and staying. Actually that land has no papers and one of my relative complains to municipality that land is belonging to municipality property. However, upon getting the complain municipality check and did the measurement. I want to know what kind of municipality takes the action legally. Is they can demolish my house? What shall I do now legally? I shall appreciate your suggestion in this issue. I am from west Bengal state.

I want evict my brother, who is a Gratituous licensee. He and his family has become nuisance to us. Rent receipts in my name. My brother pays rent and keep all rent receipts with him. How to evict him ?

dear sir,
i have purchase second hand shop . i have paid stamp duty . i have enquiry this subject to sangli collector office but i have not sanctification this sub

What is kalam 9 (a ) stamp duty act ? what is procedure get exemption of stamp duty under kalam 9 a ? i have paid stamp duty i have get refund or abutment of stamp duty under kalam 9 a & what procedure is availing exemption or reduce stamp duty ?

Property tax for charitable public trust

Dear experts

We are a charitable trust having own building and we are paying yearly property tax. Just wanted to know is there property tax exemption for charitable trust. If exempted, under which act and clause can I look in. Please suggest.

Query regarding sale of flat

I am selling my flat which I had bought from a widow the joint owner of the flat with her husband (expired)also she had a minor son at that time five years back.The present buyer's loan financing bank has asked for the following documents

1.Certified copy of Court Order to sell the said Flat wherein the
right, title and interest of son as a Minor is involved.

2. Copy of Notarized Affidavit – cum – Undertaking dated ___ executed by the
Legal Heirs stating that they are the only legal heirs and they have no objection to transfer their rights
title and interest of the said flat in favour of the wife

3. Copy of Will of her husband who has expired.

4. Copy of Probate of the Will/Succession Certificate/Heirship Certificate issued by
the Court in favour of the legal heirs of the first named owner ie: her husband
whereas we had submitted a notarized affidavit by the minor son at that time.

My question is will I have to arrange for the above documents if i have to sell my flat.
Please guide.

Non occupancy charges

Dear Sir,

The Lease Agreement of my flat duly registered has been submitted to the office bearers of our Co-op Hsg society alongwith copy of police verification and copies of several articles including of Shri.Hemant Agarwalji regarding NON-OCCUPANCY charges.

Despite of given several articles and copy of bye-laws explaining the term of non-occupancy charges our society have not stopped charging extra charges to the flats, which are given on rental. As they are might be aware about it.

The society is putting heavy amount under different head like administrative charges only for the rental flats.

Would like to know is it legal if it is decided in the AGM to charge extra charges to the rented flats.

Please advise so as to take appropriate action in the matter.

Property transfer fraud

My mother who owns her own property,is ther any possibility of fraud,as she has a single child,due to weak english reading she has a doubt that she has signed some stamp papers for her brother
Plz help me with a solution
