Documents required for changing ownerhsip of house

Hello,

My Father is no more. My Father did his will in yr 2003. In the will it is written that my sister is married and after my Father's death, me(son) and my Mother will be equal owner's in the home property.
The will has witnesses, my Father's signatures and his thumb impression. Plus there is a rubber stamp at the back of the pages. So it seems will is registered !


First, I need to know what all documents needs to be prepared to tranfer the home in my Mother's and my name. I think we need to submit the documents in GDA (ghaziabad development authority). Our's is a freehold property.


secondly who will prepare the document. do we need to hire a laywer ?

thirdly, there are many typists who sit in the court. These typists are stamp paper vendors too. one of them says that he knows how to type the application but not sure what all documents may be required ?

Is it ok to get the documents
prepared from him. he has all the application formats with him.

fourthly. There are notaries sitting in/outside the court. Is it ok to get the work done from him/her ?

Equitable mortgage

I need funding for my project against NA immovable property.
the lender wants a certificate of equitable mortgage issued by the bank or a SKR , Safe Keeping Receipt.

Need to understand the procedure to hAve the same from a bank.

U2 zone

Dear Sir,
I wanted to book a flat / plot in Sealink project in Navi Mumbai being built by M/s Landscape. This area is in demand right now due to proposed Shivadi-Nhava Railway project by gove. Their documents show that land is for agriculture but they say that it comes under U2 zone, so residence and commercial can be built upon it, no need to make it NA. I thought the land must be NA before building houses on it. I am confused and have hold my decision to invest in this project.Request your expert advise on this pl.

Eviction suit on tenant

Respected Sir's
Iam a Landlord of a property in Mumbai. I have filed a eviction suit against one of the tenants who has carried out illegal additions / alterations in the premises. The matter is at cross examination stage. At the time of giving the premises to this tenant I had given him some options that I will make a Loft , a platform, give some electric points, plumbing accessories etc at my cost. However instead of this the Tenant carried out work against my recomendations and has stated in his WS that the Landlord has done the work. I filed a suit against him and simultaneously lodged a complain in B M C. On my complain B M C issued M R T P notice and tenant filed a suit against B M C in City Civil Court. Now my question is what ever I had said that I will do the following work I have given in writing. But the actual work is totally different. I have taken inspection of the premises thro court. The advocates of the Tenant have NOT visited the premises and instead relied upon the tenant and have mentioned all the points which I had said about the work in the WS The inspection report is totally against what i had written in my letter to the tenant. So what would be the outlook of the court's. what will they take into consideration.,Is it that the Tenant's lawyers will be prooved wrong for giving false statement.Please advice. Thanking you in advance.

ek aadmi ko pahli patni se char Bache hain aur pahli patni ke rehte dusri sadi karli dusri patni koi Bache nahi hai to jamin ka hakdar kaun hoga pahli patni aur unke bache ka hak hoga ya dusri patni ko v milna chahiye aur kitna milna chahiye

Validity of an agreement

Hello,
1). I sold my property in 2007 to Mr. X, sighning an agreement concerning details of property and payment options.And received a major amount of payment within a year(not full amount yet).And no major clauses written on the agreement.

2). Now, in 2007 Mr. X sold or gave the possession to Mr. Y without my concern.

3. In 2007, the property was registered in my fathers name
In 2013, I got registered the property in my name through HIBA (as per MUSLIM law)

Does the agreement Still Valid?
Can I take my property back or not..???
Plz Help.....

Relinquishment of shares

Dear Sir,

My father had nominated myself and my brother in a flat he owned in Mumbai. After my fathers death, society transferred the shares in the name of my brother and myself on the basis of my fathers nomination.

Now I want to relinquish my 50% shares in the name of my brother. The society says, I have to give an Affidavit to that effect. Besides my wife, I have one son aged 18 and daughter aged 14.

Please advise me on the format of the Affidavit to be given to the society.

Your advise on the matter is appreciated.

Conveyance charges

Dear Sir,

I have purchase flat – resale and my old owner has already given conveyance changes and registration and stump duty fees to society, still society wants me to pay the same charges again. they are saying if deeds are not done till now you have to pay, once deed is done you don’t need to pay this charges.

I want to know if bylaws has any such procedure, please let me know as he was saying this is written in the bylaws and rule of gov.

Please help me as thy asking society transfer fees + conveyance charges + stamp duty registration charges.

Property Rights of a Child from her Mother

Hi,
My mom and dad got separated around 15 years ago, and ever since I and my sister had been living with my dad until he passed away in 2010. My dad was a retired govt employee and was a pensioner, my mom has been a govt employee too so the pension rights were ideally reserved for us and we even withdrew the pension as per legal terms. My mom has her own house and her savings which she doesn't want us to be a part of, so I just want to know what rights do the children hold for the property of their mother. FYI, she has been staying with her sister and her sister doesn't have any source of income other than my mom. She doesn't want us to be in talking terms with my mom and we even feel that she has been keeping my mom on some suspicious medication because of which my mom doesn't behave normally and says whatever she asks. My mom even met with a severe accident and she had a brain injury, hence a little damage to it.
We want to file a case against my mom's sister.
Please guide.
