sir,

matter related to IGR circular 67 issued in 2011, which deals with fradulant regn.

Madras High Court has issued stay order in 2012

Madurai Bench of Madras High Court has issued stay order in 2012

in 2014 Madurai Bench of Madras High Court dispossed the WP in favour of IGR circular 67

still Madras High Court stay order still active

enclosed copy of all court order

in the mean time i got a direction in Madurai bench of Madras High Court to complete enquiry and issue order according to IGR circular 67, but regn dept not acting to it, when a rti filled the reply i got from there is stay order in Madras High Court

guide me in this stage

Builder sent a notice for payment

I have booked property 3 months ago its ready position new flat and done agreement registered I have done yet the payment of one lack by check and put the file for loan but now builder sent me letter that I have to pay the bal amount in 15 days with the interest of 1 lack the bal amount is 23 lack now what I can do please help im not in the position to pay im helpless the bank is saying 1 more month and builder did not said anything about interest at the time of booking that if loan from bank takes time now suddenly I have got this letter is this is legal cause the property was ready position at the time of booking is there no law for the person who is going to take loan he will not get time for loan approvals please help

Confirmation deed

My grand father did POA in 1977 with the builder and builder registered that POA as a deed of confirmation in 2001.But in 2001 my grand father was not exist.He was died in 1998,his wife and son was died before his demises.Is this deed of confirmation valid?from 1977 to 2015 property cards shows my grand father name.Is the builder have right to develop plot or we have still claim on it. Please advice.

Tenant giving false evidence in 2 courts

Respected Sir's
I am a Landlord of a property in Mumbai. I have filed a case in small cause court against my tenant and simultanouesly Tenant has filed suit against corporation for the same matter which is in small cause court.In both the cases the tenant has given false evidence in his written statements and Plaints. He has not given true statement to his advocates also and that is why the advocates have filed statements on the Tenants words.
Secondly the original tenant is still alive and he has added his sons name in the premises.In the court Tenant says it is his properitory concern and in actual he has added his sons name without the permission of the Landlord. As far as I understand the law it is clear that the son's right comes over the property only after the original tenant expires.The tenant is a commercial Tenant and after his death the son should be in the same profession as his father.
What are the rights of a brother in a brothers property.
Please clarify the above queries and oblige

Hindu family property division question

I have a question regarding the Property Distribution. I belong to a Hindu Family from the State of Bihar. The property in question is registered in the name of my Grandmother. My Grandmother has died and now years later to that my Grandfather is dividing the property among my father and uncles. My father has 3 brothers and a sister of which one brother is not sane. He is mentally unstable. My Grandfather states that he will be dividing the property in 5 parts out of which 4 goes to each brothers and one for himself. I am not sure if my aunt (father's sister) is interested in the property. I have to consider that she is not interested as she is already married and she is well off.

Please tell me if the property is in the name of my Grandmother, is my Grandfather entitled to do the distribution?
How many parts the property should actually be divided in? (as one brother is insane).

Now the thing is that my grandfather is a very cunning person. He is not playing fair. My grandfather had filed a petition in the court for the property distribution. The deed has arrived. As per the information that I have the deed has names of 6 people on it, as you people have said. My grandfather did not have a good relation with my father. And he is 94 years old now. He might die in a couple of years I guess but he is giving his share to one of my uncle's kid that is my cousin and he is giving the the share of my insane uncle to the same cousin and he is getting my aunt out of the picture by not giving any part in the property or having her relinquish the right on the property.. I understand that this division is totally biased. He is asking us to possess the part of the property which we do not want. What can I or my father do to stop such kind of division. We have not signed any paperwork yet but can the division be successful even if my father does not sign the documents? Please advise what shall we do?

New tenure land purchase u/s 63 aa

Sir
I am interested to purchase new tenure agricultural land (navi sharat ) in Gujarat in industrial zone. As per sec 63 AA of Gujarat Tenancy & Agricultural Land Act no previous permission of collector is required for purchase by a person of such land for bonafide industrial use. I shall purchase land in my name right now and apply for permission certificate to collector as per law.
However the name and entity doing bonafide industrial activity would be decided later on as it is difficult to plan it right now.
Is it legally valid if I purchase land in my name and later on industrial activity would be carried out by a firm or company where I would be proprietor, partner or director? The criteria of bonafide industrial use would be complied with.

Modification in the sra survey list

Hello all,

I have a room in a chawl situated in Byculla region. It has gone under redevelopment plan through SRA scheme. The initial survey is held by SRA (with my father's name)and the list of eligible candidates is forwarded to BMC for photopass issuance.
Now there is a problem in photopass issuance to my father due to lack of voterID card on his name, whereas my mother is having all the documents required for eligibility. So could you please suggest us that is there any possibility of replacing name of my father by my mother's name in the SRA survey itself at this stage? i.e. showing my mother as the landlady so that the photopass can be issued on her name.

Deemed conveyaance matter

good evening sir,
i am secretary of my society ,i filed deemed conveyance application of my society on line ,3 hearing pass on,but sir in my case builder and landlord is not support and with the help of society members we form society in NON CO OPERATION WITH BUILDER,AFTER 10 YEARS ,my building has 12 floor B wing & 3 flat in A wing situated in 3rd floor in tenanted building ,my query is whether my conveyance is possible or not ,if not than part conveyance is possible or not ,
landlord submission copy with DDR recd by me ,in that they stat that i write wrong area ,secondly says that his tenancy right is still there in wing A than his advocate says that no question of deemed conveyance arise ,thirdly landlord & builder dispute is still going on from 2006 ,now matter goes in arbitrate ,landlord says that when my dispute with builder solve than they will convey land to my society
& builder says that my FSI is pending & development right is with me ,when tenanted building redevelopment work complete than he will convey the land ,
now in my case what will be the chance ,whether DDR will reject application or not

out of 3 landlord one of landlord,his agreement is still not registered as well as not pay stamp duty because of dispute starts than only his advocate was serve me 4 times notice ,saying that my landlord is landowner as per development agreement his right to become members,is it true or not,sale deed or stamp duty payment not require

please guide me sir
