Wife's refusal for transfer of ownership to her husband

Sir,
Regards. To keep his wife happy, he opened a IT Company, took LIC Policies and bought a car (Bank loan), etc., in his Wife's name. Now, their relationship is strained, and she is living in her parents house for the past 21 months (i.e., she did not return after delivery of first child). She is a Sadist, as it becomes clear. Now, she is refusing to sign the documents for removing her name in the Company Ownership and transfer of car in my son's name, etc., Kindly advise the legal way to get them transferred in my son's name. Charging of ifms on resale of flat

I had purchased a flat in resale in Gurgaon. The first owner of this flat has paid IBMS charges to the builder. Now on my purchase of this flat in resale, the builder is changing this IBMS to IFMS for mutation. In the Apartment Buyer's agreement between builder and buyer with first allotee is for IBMS. But on resale of the same flat, the builder wants to change this IBMS to IFMS. Kindly advise whether the builder can change IBMS to IFMS on resale of the same flat.

property

My grandfather having self earned property he left with out a will. Later my father and his brothers and sisters made a partition with their signatures know 4 years baking my father passedaway witout a will. During partition my brother and my mom signed on registered docs. However I was absent during that period. Know my question is 1) since I am not satisfied with the property which my father accepted(means location) being an elder son of my father can file a case if yes how to further. 2) know my mother is asking a share in it does she have any rights on that property. 3) still the property is on my father's name who said deceased. Can we sell the property with out my mother's signature. 4) can we sell just attaching the death evidence of my dad. Or do we need transfer it to our names or mother name(property located in andrapradesh).

Income tax / property gain

Dear Sir, Madam,

My father and my three uncles had a property on their names since 1968. As a mutual agreement in family, this property was belonged and owned by my father, and all the amount gained by sale of this property shall belong to my father only. With this agreement, that property has been saled by all four brothers in Dec 2015. All the cheques were taken on the name of my father for this property.

Now my uncles has a concern (which looks logical as per their prespective) that as they are not benefited with the sale of this property, they shouldn’t have any liability on income tax/property gain at all, they just signed on registry.

My father is fine to pay income tax / property gain on entire amount.

Please guide us with the legal process for:
1. Tax liability with my father only as he is the only person who gained with the property sale.
2. Should there be any family settlement for this?

Thanks,
Vikash Jindal

Can minors sell property.

Dear Sir/Madam,
It is all about our Father/Mother's property worth 1800Sq Ft whose legal heirs are 4 members including me elder son of which my younger brother was absconding past 7Years leaving behind his wife & 2 sons & entrusted a advocate for this work for Inclusion of name/Legal heirs,After a melodrama we are now at stage after 2.6Years we are still not in a position to sell the property, As advocate says court had partially ordered the verdict & who says she will appeal for G & WC case with high court as the verdict was an mere clerical/typographical error by judgement writer, later prompted for fees which were paid.

Till date no resolution, neither we are able to sell nor retain, incase retain they are threatening property will go in litigation.

When relative as an advocate by profession cannot be compassionate, moral and lawful, forget what a common man will be served.

We all saw lack of professional conduct and etiquette including recent interactions had with advocate, can we file a case with District Bar Association or NCDRC ? what is the procedure.

Neither advocate is willingly ready to give papers.

Regards,

Rakesh.HC
