Hello I'm Sandesh from bangalore. My question to the judicial experts, my grandfather passed away leaving his self earned property without any will. He has 4 children including my father. My father is younger sibling to my 2 aunts, the eldest aunt is no more and my second aunt is a widow. My father have a younger brother who is still a bachelor. My questions are as follows
1. My father has got 2 children including my sister and myself, what right have we got on our grandfather's property? Are we entitled with equal rights as my father, aunts and my uncle have on the property?
2. Since my eldest aunt is dead, does my eldest cousins who are two in number ( one male one female) from my eldest Aunt have any claim or right on the property. Only my brother is asking for a claim on behalf of his dead mother, we don't know the whereabouts of my cousin sister, how much of a right do they have on the property?
3. My second aunt who is a widow claims for equal rights as my father or his younger brother have on the property, is it right? How much of a right does she really have?
4. Since my father's younger brother who is still a bachelor, can he exercise extra rights on the property?
5. How does the partition happen? If my father wants to sell the property and distribute then, how should it be distributed? Is there a proportion?

I have bought a flat in mumbai thru Home Loan.( Joint loan - wherein I am the first borrower) also in case of the property I am the 1st holder.
This flat that I have bought is in a building build by demolishing a banglow owned by my brother-in-law. This building is a part of CSH. and only my brother in law is a member of the CSH. Also the property tax paper is in his name.
Though I hold electricity connection in my name I still doubt the ownership of this flat !!! In near future does my brother in law has a right to claim this flat as his property.
We do not pay any bills( Gas connection, Electricity bill nor maintenance charges too!! everything is borne by my brother in law.

can a society comiteee has the final authority to cancel a memebership of any member ?? and what are the reasons required for the cancellation..!!

I am 42 years Women, my father has Self-Acquired Property. Who died and left no will behind , which property will become ancestral property for me.
now I want to file partition suit on that property.
1)how much time it will take for partition ??
2)weather my brothers and mothers can sell my shares also??
If brother want to give property to his brother then how much stamp duty & registration charges are to paid as per Maharashtra stamp act.
My neighbour is using my property to access his home. but he already have a road facility for accessing his house. I want to construct a wall at the boundary of the property. I felt that my neighbour will restrict me in doing so. if so then what should I do. What is the easiest way out to sort out this issue.
x being owner of House had Registered Title of the same in his name.The same was purchased by his own source. later X died leaving being wife and major son & major daughter. That names of such legal hiers are recorded in revenue and Municipal records.
The Legal hiers jointly approach the Bank.Bank refuses to create Equitable Mortgage saying the Title Holder has died and says to do Registered Mortgage.
In my opinion legal hiers are capable to create Equitable Mortgage. Opinion is seeked as to what does the law says to convince the Bank.
