Dear sir,
We have a residential property (house) in Bangalore registered under my father’s name which he received through a will from my grandmother. The grandmother has declared in will that she has two kids both are males
1. My uncle
2. My father
My uncle has 2 male and 3 females and my father has 1 male child and 3 female children.
Now both the brothers have accepted the will and got their respective property registered in sub registrar office in Bangalore in 2004.
Now recently.
Problem
My uncle and his children’s have secretly sold one more property of my grand mother which was there in a village outskirts of Bangalore “ STATING THAT MY UNCLE IS THE ONLY SON .”THIS PROPERTY OF GRAND MOTHER WAS NOT MENTIONED IN WILL BECAUSE SHE EXPECTED MY UNCLE TO SELL AND DISTRIBUTE IT TO SIX SISTERS(3UNCLES DAUGHTERS AND 3 MY FATHERS DAUGHTERS)
HISTORY (1930): My grandfather had two wives
1. Wife 1 (my father’s mother)
2. Wife 2 (my uncles mother)

Now , Wife 1 (my father’s mother) passed away when my dad was very young (less than a year) later he was taken care by my uncles mother and she never differentiated between them and divided THE PROPERTY ALSO properly. ALTHOUGH, was actually earned by MY father and uncle out of respect it was registered (1960) under my uncles mother name which she showed it as self earned property.
WHAT I WANT TO KNOW THE LEGAL STAND.
1. MY UNCLE NOW SAYING THAT HE AND ALL HIS CHILDRENS WILL PUT CASE AGAINST MYFATHER TO RETURN THE PROPERTY. ( WILL COPY STATES THAT SHE HAS TWO KIDS AND WHICH MY UNCLE AND MY FATHER HAS ACCEPTED IT AND GOT IT REGISTERED UNDER THEIRE NAME ) – CAN THEY DO LIKE THAT WILL IT STAND IN COURT.
2. IS MY FATHER ELIGIBLE FOR PROPERTY - my UNCLES mother PROPERTY which was there in a village outskirts of Bangalore AS SHE HAS DECLARED IN HER WILL THAT SHE HAS TWO KIDS AND ALSO IN AFFIDAVIT SWORN BEFORE JUSTICE . WE WOULD HAVE HAPPILY GIVEN NOC FOR SELLING THE PROPERTY – GOD TILL TODAY HAS KPT US HAPPILLY ONLY .
3. CONSTANT TORTURE OF MY UNCLE REGARDING MY FATHERS MOTHER (QUESTIONING THE MODESTY OF WOMAN)

Fraud and breach of trust

I purchased a property in 2005 in mumbai and gave a general power of attorney to my brother to handle the matters in my absence as i am an NRI . I was stabbed behind my back 1. my brother added his name on the property 2. he sold part or my land without my knowledge to his wife relative 3. he collected all payment and did not pay me . the cheque which was on the legal sales agreement was cancelled and he was paid cash after one year. 4. he refused to hand over legal documents to me all the time i came down he gave excuses the paper are in the locker and will bring it later etc etc I paid the full payment for the land total 21 lakhs and he withdrawn my own money from the bank account deposited in his ac and should he paid 1.40 lakh for purchasing this land total area of the land is 56 gunthas he added his name on all legal documents and now he is not ready to cooperate. The land was sold to me for 11 lakhs and he took from me 21 Lakhs and i took loan of 10 lakhs for no reason and he keep that money for his use all is recorded on the bank statement i try to solve this issue within the family but he is not co operating for year can i file a case of fraud i am based in Dubai and cannot leave my job and come all the time please advice

Refund of token amount on flat booking

Hi - I paid 6lac by cheque as token money for booking flat. But agreement is not yet executed. During the period, deal didn't went well as many oral condition got tweaked and he asked for extra money..so the deal got cancelled.

Now i am asking for refund of money, as the oral terms and condition were not agree able to both of us..

Builder is not refunding the token money and delaying the things..what should be my course of action to get money back.

Probate of registered will

My grandfather left a registered will now we dont have any government record of that property other than this will. I want to ask whether we should go for probate to get our partition done ???

Adoption rule

I have a query, my grandfather had 3 sons, 2nd and 3rd son has 2 -2 boys each, eldest son didnt had any child so he adopted eldest son of my 2 no uncle when he was 16 year old he adopted after my grandfathers' death now claiming to have 3 share in property however my grandfather before adoption made a will and named its all 4 grandsons, property mentioned under will do not have any record in government, i want to ask how to take our property share means according to will without sue them in court, also they are not ready for any negotiations other than 3 shares

Transfer of rights from brother on property

Dear Team
We are 4 legal heirs of the ancestral property which we got from our parents after their death
This property is got muted in our 4 brothers name in 2003 As parents did not made any will so we have equal ( 1/4 part) share each
one of my brother taken a part on the road side 1/4th of the total property and living separatly
Now i am living in the balance my 1/4th part and 1/4+1/4 of my 2 older brother
they have taken their part of property some other which was already in their name and they both of 2 want to leave their rights in my favor
We want to make a deed which is not so much costlier and the rights get transfer to me
I searched about relinquishment Deed so my 2 of brother want to give me that deed in my favor

1 I want to know about Relinquishment deed
2 what are the rules for getting this deed from my 2 older brothers
3 this property is in H zone and the circle rate is about 30,000 per sq mt
4 area is about 200 sq mt which has to relinquish in my favor
5 is stamp duty has to be paid on the over all value of (200 sq mt ) property on the basis of circle rate
6 we are real brothers and this property we got from parents so how i can cut down the cost of stamp duty on value of property as there is no consideration of amount and we are doing amicably.
7 registration fee is 1000 rupee and stamp fee is 100 rupee if there is no consideration in case of relinquishment deed Is this is true as i got to know about this from e registrar website

This property is in delhi

I have a paper of mutation which is into the name of all 4 brother with equal share of 25%

Regarding probate

My parentire expired in accident they left the will.as per demand of bank we exicute the probate of will.ln which myself and my brother are administrator for that.now my brother does not ready to destribute the property as per the will .what can I do?

property rights AD

"A" received property from DDA.

"A" transfer registered and irrevocable GPA to"B" (wife) and unregistered agreement to sale and purchase to "C" Husband in 1994 . Then in 2003 "B" transfer registered GPA to "C" .
1. Will "B" able to cancel "C" GPA of 2003??
2 . If GPA not cancelled "B" have right on property?
3. If GPA can be cancelled after cancellation who's the owner rights?
4. what's importance of agreement to sale and purchase which is not registered??
5. How to convert GPA into legal registered documents?
6. Now "C" is in possession after cancellation of 2003 GPA by "B" will "B" able to enter in property legally and ask "C" to leave?
7.after cancellation of GPA if "C" didn't leave possession what legal steps we can take.?

Please help as soon as .
