Revocation of agreement

We are 5 siblings A B C D E.
I (A) signed an agreement with my brother (B) to sell my property.
Rest 2 (D, E) siblings sold property more than their legal right.
We A B C siblings did FIR.
Now
1. Status quo of land changed, but agreement remains the same.
2. Brother B forcefully using undue-influence handed me less amount than written on agreement as consideration.
3. Brother B is threatening me about filing (false) cases against me, for harrassing me by that he is creating pressure on me for invoking the agreement.

According to situations Doctrine of Frustration is getting applied, but I want to get that agreement fully revoked.
What steps should be taken??

Contract for property deed

Hi,

I have purchased a property in Haryana from a person who claims to be owner of that property but he is not legally owner of that property because he taken up that property for making profit from the owner to sale out further.

Now he sold me a piece of that property and presented himself as owner of property in contract but he is not actual owner. I have purchased a 2000 rupees stamp paper and got his sign on the deed along with sign of dealer as witness. on receipt of 3Lac I got simple sign from him instead of revenue stamp of 1 rupee.

Now, I cancelled the deed because registration is not done on that property as this is field not residential property. now deed is cancelled and they are not returning my money 3 Lac.

Is it fraud case ???
can police take any action on this to lodge FIR u/s 420 and 467??

Property transfer in case of joint ownership with mother

Hello sir. In our society one of the member is having joint ownership flat where second owner is mother. She expired recently leaving behind 1 son who is the 1st owner and 1 daughter, not in property owneeship. Society nomination documents is there in favour of son. Now son applied for 100% flat in his name in share certificate. Pls suggest process and do we need to take noc from daughter being legal heir.

Inheritance of property

Dear Sir,

My father died in Jan 2019 and was a sole owner of a DDA Flat . During his last stage he had lost his memory as well. he did not write any will when he was alive.

He is survived by his wife ( my mother) and his 3 children ( myself - son and his 2 daughters)

Would like to know as per laws of inheritance who is the legal heir of that flat. Is it my mother alone or equal share for all 4 of us i.e my mother , myself and my 2 sisters.

What is the process of getting the flat transferred in the name of legal heir.

Clarification required on changing revenue site to A Khatha

Dear Sir/ Madam,

I am Venkatesh from Bangalore. I am planning to buy a Revenue site near Magadi main road Bangalore. I need a clarification on 2 points below.
1. Is it safer to buy a revenue site after taking legal advice.
2. Is there any possible to change from revenue site into A Khatha site.

Mortgaging the leasehold rights

Dear Sirs,

I am writing to seek your advise on the write up mentioned in the Lease Deed, I am having agriculture land around 0.5 acre and all other surrounding land owners are also giving land for lease.
The lessee is interested to built warehouse, hence he approaching land owners for lease. Presently land is using for agriculture.

In the lease deed, it is mentioned like..
(POWER TO RAISE LOANS: The Lessee shall be entitled to raise loans/borrow money from financial institutions i.e., Banks, Financiers, Financial Companies and/or other Financial Institutions by mortgaging its leasehold rights in the Schedule Property. However there shall be no liability on the Lessors in regard to any such debts or borrows.)

Is this Mortgaging land leasehold rights is legal? Does this safeguard Land owners in case of any default by lessee, what are the impacts on Land owners from mortgaging leasehold rights.

How many days will it take for a subdivision of sy.no in ap?

Survey No 128/2 is of 7.76 acres Purchased By A,B,C,D from X in 1967.

A purchased 2 acres.
B purchased 2 acres.
C purchased 2 acres.
D purchased 1.76 acres.

D sold 1.76 acres in the form of plots by converting land use into Non Agriculture.

Now, C wants to sell his 2 acres in the form of plots by converting land use into Non Agriculture.

but customers asked for subdivision of sy.no 128/2 for registration to avoid confusion of 7.76 acres.

C applied for sub division in meeseva.

revenue officers came for site visit.
they prepared Sub division statement as 128/2 divided into 128/2A is of 5.76 extent and 128/2B is of 2 Acres. they took signatures from neighbour boundary farmers in statement.

for this process 80 days are gone.

still sub division is not done in online.

it is showing as 128/2 in online.

C is visiting regularly Mro office and they said file is pending before collector.
after signing by collector, sub division will be completed.

how many days will revenue people take for subdivision process?

our customers are demanding for registration. we have taken advances from them.

please advice.

Property document lost only xerox available

Hi,

My mother has only xerox of the property documents and stamp duty is not paid or registered. My father had bought this property and lost the original document, now he is no more. How do i go about getting original document and registering.

It is not possible for Society to confirm whether Applicants are the Nominee and/Nominees of the Auction Purchaser Shri Majeed Ahmed Oomerbhoy which can be verified from High Court Order dated 9th January 2009 and Undated Consent Minutes of Order filed on 8th March 2010 at time of matter appeared as Speaking to the Minutes. She is requested to give the same in writing so that drafts of conveyance will be finalized and Minutes of Meetings held before the Learned Court Receiver on 9th December 2016 in which Advocate Ms. Kanchan Pandare Advocate i/b Mr. Shailesh Thakkar, Advocate for the flat purchaser wherein names of purchasers are mentioned. On the request, plaintiff includes name of parties, signature of M/s. Oomerbhoy Investments & Ors. on the said letter. Accordingly, same are taken on record. Hence till now name of the nominee was not decided and blank name is not allowed in co-operative law as well also in general law

I HAD BOUGHT A LAND IN MAHAPALIKA AREA AND NAGAR PALIKA AREA IN MAHARASHTRA, FROM THE OWNER WHO HAD RUN A CINEMA HALL ON THE SAME LAND FOR MORE THAN 50 YEARS, WHO HAD DEMOLISH IT .
NOW I M PLANING TO CONSTRUCT A COMMERCIAL COMPLEX ON THE SAME LAND.
IS THEIR RULE TO CONSTRUCT SMALL CINEMA HALL OF 30% OF CAPACITY OF EARLIER CINEMA HALL?
IS IT POSSIBLE TO CONSTRUCT THE COMMERCIAL COMPLEX WITHOUT SMALL CINEMA HALL?
IF YES THAN WHAT IS THE PERMISSION REQUIRE?
WHAT IF I CONSTRUCT COMMERCIAL BUILDING WITHOUT SMALL CINEMA HALL ,IS IT ILLEGAL?
