Agriculture lang

Hi,

We have agriculture land which we are cultivating from past 35-40 yrs. But that land is on some others name. This happened due to less importance to the paper work in old days. Now that person is trying to sell our land and not listening to us. He was assuring us till 2 yrs back that he will give our land, but now has turn his statement totally.

Please help me to come out of this situation.

Thanks in advance.

Transfer of shares certificate in the name of widow being a joint owner of flat

Sir,
what is a procedure to transfer share certificates of a flat where a bangali hindu widow, jointly purchased a flat with her husband (her name appearing 2nd in sale agreement) desirous to become a sole member of society and transfer share of husband in her name. The other relevant fact for consideration are- the flat was purchased jointly (from self earned money)in 2008, share certificate in joint name is not yet issued by society, the husband left behind the widow, two minor daughters and mother in law as the only legal heirs.
my queries are-
1. the procedure as requested above?
2. whether the widow is entitled to transfer the share of her husband with the consent of legal heirs
3. what will be the situation if mother in law denies to sign such consent or any other document.
4. whether mother in law can claim share when it is self acquired property of husband and wife.
5. can society insist for Succession certificate or LOA from widow.

Share in the ancestral property

My father died without leaving any will and we brothers & sisters intend selling out the the ancestral landed property that was on his name. We had a sister who died issueless and her husband remarried and has an issue from his second marriage.
A)Is it necessary to include his name as one of the successors in the succession certificate?
B)Is he entitled for the share from the sale of the property?

Refund of token money

Hi,

I booked a flat @ monthly rental of Rs. 12,000 after depositing Rs. 12,000 as token money. After a week I decided not to take that flat.

After that I asked to refund the token amount. As Broker given that amount to owner in front of me only. Broker asked the owner to return it after deducting rent loss amount.

The Owner is not ready to return single rupees as he said he lost many opportunity to rent this flat because of me and within these a single week.

Please advised me what to do? I have a receipt which was given by broker on behalf of owner for token money. I am ready to deduct rent loss based on number of days.

Regards,
Amit

Purchase of beach property

I saw an advt for sale of beach property in the news paper yesterday. I called the landlord to know more about it. He told me that the property does not have a RTC(RECORD OF RIGHTS, TENANCY AND CROPS) and hence the way i could buy it is that he would give me the power of attorney when i make the payment. So my question is
1. Will this setup of taking the power of attorney without registration cause any problem in future. Problems such as, file cases against me for share etc. Whats are the risks.
2. Will i be able to apply for RTC once i get the power of attorney.
3. Will there be any problem for the govt bodies in future since this is a beach property. This property is in Mangalore, Karnataka

Your response and advise will be much appreciated.
