Recover of money paid to builder.

Sir, i entered a sale agreement to purchase three villas and two apartments with a proprietary and private limited company respectively and i paid entire sale consideration of 1cr and 20 lakhs respectively, and the condition was the builder shall deliver possession at the end of three months, if fails he shall refund the entire adavnce amount along with 12.5% as compensation for non performance and damages.

whereas builder took three terms i.e.,9 months additional time under the supplemental agreements, finally cancellation agreements executed on 24/10/11 and issued cheques for the entire advance amount along with 37.5% as the damages.

Now a days i tried to contact but builder to inform that i am going to deposit the cheques but he is not responding and avoiding me, finally i came to know he is hospitalized for stroke.

Shall i go ahead with depositing the cheques and thereafter prosecute under section 138 or shall i wait for his recovery and the take legal action?

since he is proprietor for the firm and director of the limited company, let me please advice how shall i proceed.

yours sincerely.

Ramesh

Insights of sc ruling over car parking

There is a recent ruling from SC that a builder can't sell the Still Car Parking to Flat owner as it is open sapce, but will this be applicable, post ruling or also pre ruling (I mean is it also applicable to flat owners who have already purchased the Still Car parking before this ruling, whether they will have to vacted there parking)
Please give your inputs. If you can also send me a copy of the SC ruling on solankirobin@yahoo.co.in, it would be nice and helpful.

Registration with bbmp

We recently bought a flat and got the sale deed as well as got the property registered with the BBMP. All documents are in place. Now we have doubts that the property we bought may have been constructed without sanction from the BBMP. The owners deny this but we are worried. If this is true, will we suffer in any way? What should we do?

Legal status of a joint owner of an apartment

We have an apartment in the joint names of husband and wife. Wife is only homemaker and no income of hers. Her name has been added as Joint Owner out of natural love and affection. What is her legal position during the lifetime of her husband? Chartered Accountant has advised that no amount of rental income be shown under wife's name out of property jointly owned if her share of investment is nil. Husband wants to make a will. Can he do it for the entire property? Does the law require both husband and wife to make separate wills ? Is it possible to make a will by both husband and wife separately? What are percentage shares of both owners?

Property of hindu female

Dear Sir,

Please give your reply to my query:

Hindu Female inherited property from her Father in Law by way of will. Father in law acquired the property from his own income. Later on Father in Law transfered the property through will to his elder son and deceased younger son's wife jointly.

The Elder son & deceased younger son's wife have made the partition of said property though registered partition deed.
1. Whether such property will be treated as seprerate property of Hindu Female or it will be treated as Joint Family Property.
2. whether grandson of Father in law (Son of deceased younger son) can claim his share in property?
