I am planning to give on lease my flat in mumbai to two girls but society told they will not allow to give flat on rental basis to singles, i heard supreme court gave a judgement (reference news paper mumbai mirror dated between 8-12/9/2011) that societies cannot that societies can not stop giving flat on lease to singles) please suggest on the and please provide the reference of such judgement)
Dear All,
I heard last month Supreme Court gave a judgement( in Times of India paper published in 10/2011) that no property sale transaction can happen on Power of Attorney holder basis, Sellers have to present personally for Registration of Sale Transaction.
kindly make me educate what is the judgement and when it was published because one of my friend is staying out of Maharashtra and he gave power of attorney to me in 2006 to sell a property in Mumbai, kindly suggest can i enter in to a sale transaction and do registration, or my friend has to visit personally.

Dear Sir,
Further to my issue ,in case of the court orders for demolition,
can I appeal the court to order for such demolitions of the pre existing shops in the locality of similar nature.
( that were already running prior these shops construction) under the following conditions in the constitution.
Actually builder referred these shops to me and then sold to me.
Article 14 Equality before law
The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.
Part IVA Fundamental Duties
Article 51A Fundamental duties
(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
2. another suggestion:
actually i find that there are only less that 30 % occupants had cars, since these 20-30 flat apartment blocks had most of the middle class families.
it is more appropriate to leave the frontal bay for petty shops not more than 150 sft each and then leave the remaining for the car parking 30% and rest for motorcycle parking. 250 sft can be for the watchman.
even you restrict by law, people are tempted to misuse. WHY NOT AMMEND THE LAW AND PUT AN END TO THE MESS.

[ Scorecard : 26]
buyer pays for builder / officials mistakes.
the fire approval for the pent houses / flats in cellars is also leading to huge fines.
GHMC should regularize all pent houses immediately irrespective of FIre and aviation approval.( where got 18-24m buildings hindering the aeroplanes) . because when builder cheated the buyer, they are fining the buyer.
regarding the fire, i got some suggestions.
1. fire escape is important. relatively most of the apartmentment block did have the regular staircase within 15m range.
2. actually it is not practical to construct the water tank of 25KL over the terrace. Irrespective of BPS, the GHMC should insist all the apartment blocks to have a riser / drop down pipe connected one full vertical having outlets at each floor. the dia should be 3" pipe and each floor should have 15m hose reel.
the raiser can be connected to regular water tank.
there ends the matter. most of the buildings will comply to this and some definite PRACTICAL protection is possible.
this will end to unnecessary curruption.

Hi, I am planning to buy a property in partnership with my mother-in-law. She would invest 50% while I will invest the other half. She is planning to sell her old property and fund the current 50% for new property. My mother-in-law has 2 daughters.
We are planning to put in an agreement in place wherein my wife's sister nor her husband or kin will hold any right in the property. A fixed amount equivalent to half of the amount obtained by sale of old property will be provided to them at the end of 20 years.
Will this agreement hold good for any future legal issues if faced. Also, in order for me to obtain home loan from bank will this be sufficient enough.
Will my mother-in-law need to have a will made talking about the above in addition to above agreement paper

Suit for redemption of mortgage
Dear Sir,
In a suit for redemption of mortgage, the court directs the plaintiff/mortgagor to redeem the property within two months by depositing the mortgage-money alongwith interest.
But the mortgagor failed to deposit the mortgage-money alongwith interest within the stipulated period of “two months” but deposited only after the expiry of four months.
What will be legal consequences since the plaintiff/mortgagor will lose his rights since he had failed to deposit the mortgage money within the stipulated period of two months?
Kindly advise me.
Thanks in advance to the learned Experts for your kind advice.
