Gift deed to a grand daughter

Dear All,

When i approached a Document Writer regarding transferring my father-in-law's self-acquired property to my daughter as a gift deed, he said that we have to pay 6% as it falls into 'others'. I was not convinced though. Since my daughter's surname is different to my in-law's surname it falls into 'other' categories, he claimed.

I believe that we have to pay less stamp duty as she is a blood relative. The property is located in Telangana.

Do maternal grandchildren qualify for the 'blood-related' category of a Gift Deed? Please suggest me.

All defendants consent is required to submit the objection ?

In a partition suit, there are 8 defendants.

For a given Plaintiff written statement and request for amendments -

1. Can only Defendant 3 can file objection without mentioning other defendants ?

2. Is it right to mention as "defendants already filed their written statements" by Defendant 3 alone in objection?

3. Does court considered this as all other defendants have agreed to what Defendant 3 is saying?

Registeration of lease

We have a tenant at our commercial stop in Noida since 1st April 2021. Lease agreement was not registered earlier and now we want to register rent agreement. Previous agreement was of 3 years but only notarized. Now we want fresh registered agreement for 5 years.

My Query:
1. Since previous ageement was of 3 years but was not registered does it has any value and
2. If we go for registeration now with same tenant for 5 years do we have to pay any penalty for not registering agreement last year
3. Should we make a fresh agreement with fresh dates in that case how do we mention security money that was given to us last year
4. Can fresh agreement be made now mentioning date of agreement from 1st April 2021 onwards for 5 years i.e to 31 March 2026? Will that be allowed and legal?

Property case by brother in 2 courts i am married women

Property case by brother in 2 different courts - i am married women

There are 2 property case going on
1 case has mine land property in which brother is claming full money even when all property papers like Land registry ,mutation ,sale deed ,Khatauni on bhulekh all papers is in mine name only .

what he is doing in this case he is telling court that he want full money for mine property as it was purchased with fathers huf account money . and father gave money from Huf to me and i purchased land from that money , land regisrty is approx 35 years old.
what is interesting i was never part of Huf as it was never formed .

Father cant give any money to married daughter he is giving this rule which is not correct according to law. Father has earn lakhs of money he has right to use his money how can he stop even if this is correct that father gave me money . Father is no more and father disown mine brother already 15 years ago for threating to kill him for fighting with him for troubling mine mother and fir was already filed by mine father in this matter at time of disowing him.
also when mine father died he troubled mine mother age 80 years approx so so much that she has to left her own house and stay with other brother (house registry in mine fathers and mothers name)

in other property case mine brother telling girls dont have right in fathers property so he is not giving me any share in fathers property ( shop , land , money in bank account)

so he is not giving me share in fathers property and neither allowing me money for mine own property , as he is telling proof that i mineself paid money for mine property .
he never told court registry is who's name , only creating confusing everytime giving written questions to mine lawyer on court date and asking him written answer , this is going from many years .

father is no more and father disown mine brother already 15 years ago for which he is still fighting and never won case that case till mine father was alive .

he is giving false statements in court .
what is punshiment for giving false statements , affidavit in court
also
will this case comes in blackmail , extrotion , fraud with me and fraud with court as he is giving false statements in court.

Discrepancy in land area shown in patta

Dear Expert,
I have inherited a piece of land from my deceased sister in Tamil Nadu. the Original Sale deed as well as the transfer deed shows the area of the land as 1744 sq ft. There is a house built on this land after proper survey was done by the Tahsildar, and building plans approval by the Panchayat.
The Field Measurement Book records also show this land to be 1744 sq ft.
However the Patta shows the measurement as 1600 sq ft. I didn't notice the discrepance earlier since the patta figures are given in hectares,
How can I get the patta discrepancy corrected?

Partnership firms 7/12 extract name change procedure

Dear Sir,
A partnership firms registered with ROF mumbai owns land through its three partners having firm name along with 3 partners on 7/12 extract. all three partners resigned and two new partners take over firm by investing 100 % capital money outgoing partners resigned and released all their rights, share in favour of new partners as per partnership deed reconstituted as admission cum retirement deed duly notarised before advocate in mumbai.
For change of 7/12 extract on new partners and removal of old partners name what is the legal procedure as per partnership act and Maharashtra land revenue act.

pls explain proper legal procedure to change 7/12 record of right.

Brother & sisters not leaving flat sold by father

My Father sold his flat in Sept-2021 but my brother and his wife continued living in the same sold flat till now due to balance payment from buyer was due to come. Now my Father has received full and final payment for flat sold. My brother & his wife are now not ready to leave the said flat & Buyer wants immediate possession of the said flat for he wants to move with his family. What actions can be taken against them if they do not leave, please help !

Acquired property by government

Dear Sir,
My father had purchased a 60 x40 feet site in1967 located in district headquarters of Tumkur city in Karnataka state from a reputed layout developer approved by the Tumkur municipal corporation and DC at that time and no civil construction was undertaken till this day on this property.
This property after my father demise in 1989 was subsequently was transferred jointly among his 5 children's ,the property tax for empty site was paid till 2015
Now the property has been acquired by Government PU College in2018-19
Now our MAIN QUESTION for you is can we get COMPENSATION from the Govt PU college and if so by what means.

Common wall law

My neighbour left house around 20 years ago and we also left our 4 yrs ago. Till now he has not done anything to his house to demolish it. After repeated attempts by other side neighbour he has partially demolished. Now we want to construct new one on our place, but as his house is of no use still he is not ready to demolish his useless partial construction. We need to construct and want tour common wall.

Property papers misplaced

I am the holder of a commercial property ,purchased through sale deed from my grandfather ,in 1982 .
I had a joint family and my brother used to keep all important documents .
I remember giving the sale deed to him for safe custody .
There were some disputes in family in 2013 and I decided on living seperately ,
in another city (25 km).
I asked for sale deed at that time .
He said that he has kept it somewhere .
Would search and provide me the sale deed (which he never did).
I decided to take a bank loan against property (15.02.22) and sent someone to muncipal corporation to clear pending property tax .
(assumed to be pending for about 3-4 years)
I was being informed that property tax was fully paid by my brother son ,for last year (on 13.01.22) and previous years .
My brother and his son have been meeting me for past 5 months to discuss other pending property matters but they never informed me nor demanded amount paid as property tax ,against my property ,which clearly shows their ill intensions .
Please advice legal process to avail bank loan as original sale deed is not available
and if same is not possible ,kindly advice measures to be taken to safeguard my property .
