Brother & sisters not leaving flat sold by father

My Father sold his flat in Sept-2021 but my brother and his wife continued living in the same sold flat till now due to balance payment from buyer was due to come. Now my Father has received full and final payment for flat sold. My brother & his wife are now not ready to leave the said flat & Buyer wants immediate possession of the said flat for he wants to move with his family. What actions can be taken against them if they do not leave, please help !

Your father sold the property to others. So your father or his legal heirs have no right to take action against them. The buyer of the property shall file a case against them in court.

Hello,

Yes, the buyer can take legal action against your brother and wife.

However, the buyer may ask your father for vacating the flat. So it is better your father will also help the buyer for vacating the flat.
