Building maintenance charges

Our building is 20+ years old and has 7 flats (owners). It is yet to be registered as a society. 2 flats on the first floor is owned by 1 individual. For the past 5+ years, the monthly maintenance charges is not being paid by the owner while uses all the facilities like water, parking, common lighting, etc. He also runs his business within the premises. Throws around weight by asking his customers to park inside the building and his driver always parks his vehicle inside the compound. As the members can't afford to keep 2 security personnel, we only have a night watchman.

how can we demand and fix this man's irrational behavior?

Regarding ikrarnama stamped by tehsildar

My father and two his brother had a property by will from my grandfather in 1955 in equal share.
In 1971 both brothers of my father had left their part to my father by a ikrarnama.
The ikrarnama (tyagpatra) was attested by tehsildar and stamped also by tehsildar on that day not by sub registrar. Also tehsildar had written by hand about tasdik of documents and persons like my fathers brother and two witness
but he does not mention page no of his books.
my father had made a will to me and expired in last year. When I goes to munciplity for name transfer , they say ikrarnama must be registered by subregistrar not by tehsildar and refuse to transfer it . Is it not valid by a tehsildar or is it our fault if in office anybody by mistake put it up the stamp of tehsildar since in our city office is same of tehsildar and subregistrar.
please help me what I have to do know

Confirmation deed

Hi,

I bought a site in Bangalore in 2011 from 3 brothers who said they are the only successors of the site from their father Late.P.Gowda. The 3 brothers had given me a family tree which was attested by a village accountant, and had only mentioned the 3 sons to their father. I now know that the family tree should have been registered, and only then it is a legal document. Unfortunately none of the 3 lawyers I had consulted before buying the site informed me about this.

In 2012, two of the daughters of P.Gowda surfaced up and they are asking for some money.

Though I am the victim of the fraud here,
with no hopes in the law, I am going for a settlement with the 2 daughters, and getting a Confirmation Deed done.

Apart from the basic clauses, I wanted to know what are the other clauses I can add to the deed to make sure I do not have any more problems with the site. I also want to sell the site soon after this deed.

Thanks,
Sunil

How to partition

Dear sir,

My case ... help needed

I and my mother live in a ancestral house and are in some bad financial conditions. We want to sell the house now worth 11 lakhs, but are facing problem..

FACTS:
1. Land was purchased by grandfather in 1957 , house built in 1967 and is still in his name.
2. He died in 1988 without will leaving behind 5 daughters and 3 sons. All lived in the said house.
3. The daughters (my bua) are married, alive and living in different cities. The three sons (tauji, my father and chacha) passed away in 1995, 2002, 2008. Only my father had one son.
4. As of today, I my wife, children and widow mother live in said house. Due to financial conditions, we want to sell the house..
5. Buyers are asking for signatures of 5 daughters (buas), my mother and I or a vaarisaan (succession letter) in our favour.

PROBLEM : the daughters deny to sign on sale deed or do any partiion

Ques :
1. As the owner (my Grandfather) died in 1988, do his daughters (my bua) have any right in the house.
2. If they do have right, can we get the house (our share of it) sold somehow or get our share of its value even when they refuse to do so willingly.
3. Will our share be 1/7 for my mother and 1/7 for me.

PLEASE HELP

Share of married/ unmarried sister in father property

Dear sir,
It has been a pleasure to get correct legal advice from all of you... I have another querry

My friend, rakesh has two sisters..
Their father died in 1990 without will. At that time rakesh and one sister were married while one sister was minor & unmarried.. Mother is alive.

All the properties were being handled by rakesh till date. He got the second sister educated and married her off nicely.

the new brother in law turned out to be a abusive problem creator. They are threatening him of legal actions to sell father's property, i.e. the only house, where rakesh & family resides..

It is understood that before 1994, married sisters had no share in father's property..
Q1. Was it same for unmarried daughters
Q2. If division is to be done, will it be in four parts or some other system apply.

Kindly help

Diversion and batan of land

Dear Learned Lawyers,

We are facing huge problem to sell off land because of diversion and batan for piece of land in Bhopal (MP)- we urgently require money and this is taking just too long!

Following are the case credentials:

1. Registry and mutation has been done
2. Diversion and batan is taking too long, a person who is close to us is looking into this matter since last 3 years, every time there is a new excuse from his end, net result the diversion and batan are not done even after he allegedly run from pillar to posts for said time!!
3. To make things worse, I don't know details of the work to be done, and now making my mind to get this done myself.
4. We live in UP and hence cannot monitor it on day to day basis- can the authorities take undue advantage of this fact?

Is there any able lawyer from Bhopal who can guide me in this matter, and should at first place I should approach lawyers since authorities are not listening even after 3 years!!! (as per that middleman)

Regards,
Ankur
