Leased mortgage of trust properties before rebuilding

Dear Sir/Madam,
Wish you a good day.
The question is whether a dilapidated premises needing rebuilding under Charitable Religious Trust Deed irrevocable could be taken up for rebuilding under leased mortgage basis. The property is situated in Kolkata metropolitan City in a very important area under Kolkata Municipal Corporation jurisdiction.

Look forward to your considered opinion.

Gpa land purchase

Dear Sir,
Require legal opinion on validity of below transaction.

1. "A" had given GPA (for consideration amount) & Possession agreement to "B" in year 1999. This is notarised GPA & not registered because of financial problem of buyer & same reason is mention in GPA also. GPA carries Name & License number & signature of notary
2. Khata transferred in the name of "B" by Bruhat Bangalore Mahanagara Palike.
3. "B" executed sale deed in name of "C" which is registered & stamped in registrar office in yr 2003.
4.Again Khata transfered from "B" to "C" by BBMP.
5."C" executed gift deed to his brother "D" in yr 2009.
6.Encumbrance certificate shows all the above transactions ie "A" to "B" via GPA, "B" to "C" via sale deed & "C" to "D" via gift deed.
7.Property tax is paid upto date by "C" & "D".

Now pls suggest if we can purchase this plot from "D" as seller & "C" as confirming party.

If this plot can be purchased, then what precautions to be taken?

Query to file delay w.s. in coop. court.

In Mumbai Cooperative court, my Hsg. society (Respondent) has delayed in filing the W.S. for 130 days beyond 90 days period from the receipt of summons granted by the court with justification that all the 9 committee members were on vacation.

I (disputant) have strongly opposed to take w.s. on records to the court for delay caused.

My query is:

Is going on vacation a legally valid reason in spite of 130 days enough time frame available with the respondent?

Thanks in advance for your replies.

Renovation without consent

I and my father stay in a flat with my uncle and his family, the flat is in the name of my great grand father. I and my uncle don't share a good relationship and hence we have issues with property. Recently as i and my father were out of station, he started to renovate and redesign the flat without my consent moving my stuff. I would like to know if he has a right to modify or redesign anything in the flat without my consent? What right do i have in case he claims the flat to be his or what action should i take to stop him from doing so? please help and guide.

Rent agreement

I am negotiating for a residential flat on rent on monthly tenancy basis. The flat in question is a flat made out of two flats, both owned and registered in the names of two female members of the family, one being mother and other being daughter-in-law.However both females have made separate registered gift deed in favour of one male member of the family, who happened to be son and husband of these ladies.Unfortunately the son has expired in sudden accident without any will or so.. and now both the females desire to let out the same flat to me . The terms are settled. My question is that:
who is the owner of this flat now?
can these two females give this flat on rent?
if so then who will issue me the rent receipt, i.e. who shall be bonafide-legal landlord.
If these females can let out the flat then in whose name they would issue me rent recept as owner of the flat.

I am to get re-imbursement of the rent from my office and the rent agreement and rent recepit should be perfect in order.
please guide....
regards

Common terrace maintenance

Dear sir/madam,

I owned top floor of the 6 flat apartment (2 flats on each floor) in Ahmedabad City, Gujarat, India.

Since earthquake there were minor/major cracks on the common terrace and started to leak heavy water in my both flats. I have done water proofing treatments 3 time costing approx Rs. 60,000/-. I have requested to all members of the building to contribute but they are refused all the time. On this monsoon water leakage problem goes worst then ever.

I have asked professional to stop leakage and they have given me approx. Rs. 1,50,000/- budget to solve the problem.

Now my question is weather there is any law for common terrace maintenance to be done by all members or I have to do it by my pocket only.

Waiting for your kind reply.
