One of my client had a premises in which a temple is there which was owned by landlord and outside it a shop was given to client grandfather by the same landlord and client paid the rent accordingly till 1998 with a condition that rent received will be used in temple repairs and renovation work but then landlord died in 1998 and about after that a IL-legal trust was formed in the same premises where a temple exists from that year 1998 rent has not been paid as my client refused to pay the rent to that IL-legal trust and landlord legal heirs don't have any succession certificate which was let-out by the landlord. Now my question is that my client made a query that how to pay the rent and whom to pay the rent as client has the property for more than 50 years. please advise as per the UP RENT CONTROL ACT 1972

Respected Madam/ Sir,
I booked an apartment in Gurgaon in May' 2012 and made 20% payment. For rest of the amount, installment(EMI) started from July' 2012.
Now, my builder sent an additional demand for service tax on following items:
1. 12.36% on EDC, IDC.
2. 12.36% on club membership.
3. 12.36% on IFMS (Interest Free Maintainance Charge).
4. 3.09% on parking.
I didn't pay any service tax on these items before.
My query is:
Is service tax applicable on all of the above and %age of tax is in accordance to the government rules? If so, please help me have the government circulars.
Thanks for your help,
Madhu

Dear all,
My elder sister who stays with us with her husband and draws a salary of Rs.30000/- around and her husband who is a property dealer and a owner of a tata sumo and also his mother's property, are saying that we[our elder sister and her husband] have every right to stay in our parent's house lifelong though both are earning handsomely per month. Our parent's property is in their name.My question to you all are...
1) What does Indian law and Hindu marriage act say about this?
2)What is the supreme court and West Bengal High court direction's are as we stay in W.B in this matter?
3)If my father says that his daughter and her husband will stay with me and if my mother says "no" to it then what is the solution as both are the co-owner of the property.
PLEASE HELP..
A tenant is staying in a flat for last six months after excuting a proper Tenancy Agreement under Tenancy Act and pays Rent regularly. Now a Bank has approached him for securing the possession of the Flat as the flat had been under their Mortgage by the Owner of the Flat who is defaulter in repayment to Bank. The Bank says it has served the notice to the owner under sarfasi. What is the status of the Tenant under this circumstances?

I am about to buy a property , please guide the details being as under:-
property belongs to a muslim lady A, who dies intestate. She has 3 legal heirs namely X ie son , Y ie daughter and Z also daughter. The son X dies leaving behind his two legal heirs ie his two wives:- J and K only.
That now their are 4 legal heirs namely Y, Z, J ,K.
All of them decide to sell the land. and execute sale deed in the year 1990 and get it notarised. In this notarised sale deed the Y and Z as vendors , J and K as confirming parties and P is the Purchaser. The sale deed also states that their was a doispute between Y, Z and J, K and was settled accordingly.
Now P the Purchaser also died leaving behind his legal heirs R his wife and Q his daughter. The daughter ie Q has relinquished her rights as per some document , not present. I am about to buy the property from R.
Query is :- The property card reflects the name of A the lady as the owner.
no records are their . The purchaser P did not transfer his name on the property card . So what the whole process to get the property cleared and should i proceed to buy the said property.
Buy a housing property of guarantor.
I want to buy a housing property of a Guarantor of business loan, obtained from SBI in 2010 Amt 1.5 crores.
Now loan is taken against mortgage business property and as a guarantor his wife gave guarantee. And his wife (i.e guarantor) , holds one housing property.
But in 2012 due to business crisis, loan borrower failed to paid dues with the bank.So bank put charge both of the properties i.e. business premise as well as housing property of his spouse.
Now recovery dept of SBI bank with reference to SARFAESI ACT,settle all dues for 1.12crores, withdraw charge on "Housing property of Spuse",If he pays 65 lacs within 15 days and remaining amount in 45 days then bank will withdraw charge on business premises
Now i am having interest to buy housing property and pay 65 lacs on behalf of guarantor and she transfer property right in my favor after withdraw charge by bank.
So is it advisable to buy a property ?
If yes then which point i have to keep in mind or how can put myself safer side against i pay 65 lcas on behalf of gurantor
