If a person is having more than one mortgage on his flat which would obviously be not known to the societies secretary. Now the person wishes to sell his flat and asks for NOC. What are the detailed procedures for the SECRETARY to safe guard his position.Is paper advertisement about sale of flat also a solution and can the person harass the secretary and demand NOC.

If Mr. X does not inform about his mortgage on the flat and gives application for NOC for sell of flat without mentioning these things and if the secretary gives the NOC. What are the consequences.

Dear sir,
This matter is from our society, the previous committee's chairman is not handing over the charge of society and the required NOC of previous committee to the bank to operate the account by the new committee. He was not traceable for couple of months and was not answering any phone calls or SMS sent to him. Now after couple of months he is contacting us over the phone only and not meeting in person and telling the committee member's that he will not sign on the bank's NOC and will not Hand over the charge to NEW committee, whereas his tenure as a CHAIRMAN is over on March 2011. Sir what can be done with this regards kindly guide us and let us know the procedure.

this is a query about a case in our society the member who wants a NOC to sell his flat has mortgaged his flat with the bank, also he is a defaulter with the bank as he has not been staying in our society for past 6 months and there are numerous bank people coming to search for him. Also as he was a previous committee member and a current committee member he has not handed over the bank formalities of the society, hence the new committee is facing problems to carry out the day - to - day work and pay the bills , taxes , etc. Now that person wants a NOC from society. Please give us detailed solution and also give clarification as per bye-laws.

Mr. A died interstate, leaving behind 2 sons and wife. i understand that they will get equal shares but what are the various legal documents that need to be signed by the legal heirs to receive their equal share?

Petitioner wife has filed divorce case. She has only marriage certificate as proof. 3 years have been completed to marriage and 18 months to petition. She is living separately just after 3 months of marriage. Even she has not entered her name in the ration card of husband. Now she want passport. But situation is such that case is going on. She has no document as a proof of residence. in this scenario can passport authorities will passport to her? if yes at which address? if she declares her as unmarried she is filling wrong information which is punishable under passport act and if she tell true passport authorities will ask her to produce address proof or decree of divorce. Whether court's permission necessary?
