Will

1.Does a Unregistered Will acceptable as evidence in Court of law /provide title in any transaction- say name change,claim for any property etc?.
2.Should all legal heirs be informed about the existence of will and actions carried out based on it?
3.Does there exist a necessity to bring all legal heirs into the picture or can some be left uninformed(Daughter getting married against family's will)?.
4.If the Date of Registration of Will is not known is there any simple way to obtain a copy of the Will by(Daughter getting married against family's will and in no touch with family members)?

Dear Ajay Sethi Ji,

Thanks for your comments to my to-day's query on the above subject.The executantant is having PAN .She is now studying in USA and presently in India staying in a Flat hired by her father.She may remain out of India for some more years.The executantant desires to give the power to her father to purchase any immovable property on her behalf.Pl. advice if the deed is executed in South Delhi and if presently she has no property,can the GPA be executed at any place in Delhi.

Is it possible to obtain a copy of will written by the deceased.
1.What details are must to obtain it?
2.Where to apply for it.?

Can GPA be registered at any place in Dehi ,if the executantant,who is an NRI temporarily lives in South Delhi in a rented accomodation and presently does not own any immovable property .The GPA inter-alia contains power to acquire/dispose off immovable property?

Chance of forgery in sale deed

I HAVE DECIDED TO SELL MY PROPERTY AND HAVE APPROACHED A BROKER FOR THE SAME. HE HAS ASKED ME FOR THE PHOTOCOPIES OF COMPLETE SET OF DOCUMENTS(SALE DEED, PARENT DEED ENCUMBRANCE CERTIFICATE HOUSE PLAN APPROVAL ETC) IS IT ADVISABLE TO GIVE THE PHOTOCOPIES TO HIM OR IS THERE ANY CHANCE OF DOING FORGERY IN THIS CASE WITH FULL SET OF DOCUMENTS BECAUSE THE BROKER SAYS IT IS NOT POSSIBLE TO DO ANY FORGERY EVEN WITH ORIGINAL SET OF DOCUMENTS. IS IT SO? PLEASE ADVISE ACCORDINGLY.

Gift deed

I want to ask my father is planning to invest in new property out of the funds he will receive from my grandfather on account of sale of his house. The rest two brothers of my father didn't want to invest right now. So basically my question is there is any alternative that in the near future registry of the new property purchased by my father will be done only in my father's name as a main applicant, not as a co- applicant with my grandfather so that there is no possibility of claiming any share by the rest of the two brothers in that property in the future.
& What are the implications of Gift Deed?

Need supremo court judgment copy on condone delay

My one friend needs following. He mailed me his requirement as under:

"I need help from you. I need to find a Supreme Court judgment

Issue : I need to transfer my father's membership in the co-operative housing society in Delhi from his name to my name. Due to my being busy, over 365 days have elapsed after his death and so permission of Registrar of Co-operative society is needed.

What I need : I have applied for delay condone. And there is a Supreme Court judgment which says that delay condone for upto 7 years must be allowed.

Can you search that judgment for me?

And if there is any charge, I would be more than happy to pay."

Kindly help him.

Power of attorney

Dear Experts,

I am seeing a Power of Attorney in which the date of resolution of granting POA is September 14 and the effective date of POA is June 30 and also it says that subscribes our hand this June 30. Is it a correct POA? Can we state in the POA that it is granted in SEPTEMBER and it is effective from June.

Basis of caste certificate

Sire, I want to know the basis of caste certificate. On what basis it is made? Is it birth in a particular state? Or residence at a place for a particular duration? Can one person possess caste certificate of two states although same caste and has residence at both places - one traditional patriarchal residence and other born in migratory nuclear family residence?
