My father expired recently on 24th Sept. 2012.He is survived by my mother, me and my brother.I believe that we are legal heirs.
My distant relative(an uncle, at whose house my father was staying when he died)has usurped all bank books, certificates, flat papers, etc...
We have issued a legal notice to him to recover those documents.
We fear that he may create a false will and give it up for probate in west bengal, where he stays and we may be left in the dark as we are staying in mumbai and due to mother's health reasons cannot travel there as of now.
Can I know where a person approaches in case he wants to probate a will. And what can we do as class-1 legal heirs to stop a false will from execution/probation?
That relative stays in Chandernagore. Hooghly district in west bengal.
Most of my father's liquid assets lie with banks in Chandernagore and Kolkata.

Experts pl advise what happens in the case of GPA
Q1) Mother gives one son her GPA which he uses as Attorney holder for 2 years in an Appeal by mother still pending final orders while interim stay orders have been given.
Q2)Another son who is against his brother as well as against the said Appeal for his ulterior motives has the GPA revoked thereafter through public notice which he engineers after brainwashing very old bedridden mother.
Q3)Mother passes away and first son thereafter files for substitution in place of Appellant U/o 22 R4 of CPC, 1908.
Q4)Notices are issued to the LR's on this application under O22 R4.
WHAT IS THE LEGAL POSITION.

My father passed away on 24th Sept, 2012.
He was in calcutta with his cousin brother at that time. He was cremated there.
He has a flat in navi mumbai in a society registered with cidco of which my mother is the nominee.
the problem now is that my cousin uncle has taken control of all important documents belonging to my father, including the death certificate, pension nomination papers and also this flat nomination paper/share certificate.
in the absence of these documents, my mother cannot apply for transfer of property in her name. she is 65 yrs of age and staying with me(married daughter)in navi mumbai and having health problems.
he is not giving her the papers, instead asking for money!
can anyone suggest a course of action please.
i would like to mention that we have a scanned copy each of my father's(Retd. Sc.Officer, BARC) and PPO order, his identity card and medical(CHSS) card. all scanned copies.
can my mother apply for transfer of property on basis of these?
Kindly reply.
