Hi,
I am divorced in January 2013. My spouse name is added in my passport. Divorce document is on a Notary. In a notary we had added a clause that “both the parties are agreed that in future they are going to sign in a court if need is arise from any side”
I want to remove her name from my passport and I came to know that court decree is necessary to make any of such change.
I thought that filing a petition and making a case against them will eat lots of time and money. So we tried that things will move based on mutual consent but now they are refusing to make any such kind of signature. They are very well aware that they have agreed in a notary documents too.
I came to know about Annexure – K. I am not sure if it may help me or not. This is to be sworn before First Class Judicial Magistrate on non Judicial stamp paper. While making this document, do I have to produce any filed petition? or what are the documents which will be demanded by the Judicial Magistrate in this case.
Kindly suggest any other alternative is possible.

Sir,
I have applied for transmission of mutual funds. But the company has rejected my application stating that there is mismatch between the name as mentioned in the folio number and as mentioned in the death certificate.
Actual Name: SUDARSHANA
Death Certificate: SUDHARSHAN
Now they have asked to submit an affidavit stating that the names mentioned are one and the same.
Please advice me how to draft the said affidavit and consequences of giving such affidavits.
(Note: Actually, it was registrar who wrote the name wrongly while issuing death certificate.

Hi,
i am looking forwards for a query which is related to partnership registration
My friend advocate by profession unknowingly entered into a Partnership firm as a working partner and have applied for registration of the same at the concerned Registrar of Firms.
But the registrar of firms now have issued a objection towards the said registration of partnership firm and asked for No Objection from the Bar council of india/state for the same.
Now my friend is not willing to continue with the said firm as a partner and looking forward to retire himself and have to continue with the advocate profession.
Kindly help me out with this case

I am applying for a passport but they have told me to first rectify my name.
All other documents of mine like Voter Id,PAN,Aadhar etc. have correct name printed on it.I am 22 years old.
Please help Sir on what needs to be done to get my name correct.

Hi,
I own a open plot and entered into a sale agreement this year in the month of May by taking an advance amount of 25%. The buyer has failed to pay the balance amount before the specified time of 45 days mentioned in the agreement. It has been six months since the payment due date reached. But due to recent hike in land prices he is now trying to force us to register the land on his name. We do not have a copy of agreement with us and agreement was not registered as well. Now We don't want to give the land to him. The content of the agreement is pasted below.
AGREEMENT OF SALE
This Agreement of Sale is made and executed on this the 13th day of MAY, 2013
BY AND BETWEN
1) Smt. ------- W/o Sri ------, aged -- years, Occ: ------.
(hereinafter referred to as the VENDOR which term shall mean and include their respective representatives, legal heirs, successors in interest and assigns etc.,)
AND
1. Sri -----, S/o -----, aged 3--, Occ: -------.
(hereinafter referred to as the VENDEE which term shall mean and include their representatives, legal heirs, successors in interest and assigns etc.,)
WHEREAS THE vendor herein is the absolute owner, title holder and possessor of the open plot bearing No.--, admeasuring -- sq.yards or -- Sq.Mts in Sy.No.--, Situated at ----, (Herein after referred to as the said property) more fully described in the schedule annexed hereunder.
AND WHEREAS the vendor herein had purchased the said property under a registered sale deed, dt. --- vide document No.--- from the respective owner and title holders Sri -----.
AND WHEREAS the vendor herein has offered to sell the said property and the vendee have agreed to purchase the same on the following covenants mentioned here under and entered this agreement.
NOW THIS AGREEMENT OF SALE WITNESSETH AS FOLLOWS:
1) The vendor has agreed to sell and the vendee has agreed to purchase the said property, for a total consideration of Rs. ----- (Rupees ---- only). Out of the said total sale consideration, the vendee requested the vendor that he shall pay 25% of the total sale consideration and the vendor has agreed for the same for which the vendee has, this day paid a sum of Rs. ----/- (Rupees ---- only). The vendor hereby acknowledges the receipt of the same in part performance of this agreement of sale.
2) The vendee shall pay the balance amount of sale consideration for Rs. --- (Rupees ---- only) within 45 days from the date of execution of this indenture.
3) Upon receipt of the balance consideration, the vendor hereby undertakes and executes and registers the sale deed with appropriate recitals in favour of the vendee.
4) The vendor hereby declare and covenant that the property now agreed to be sold, is free from prior mortgages, prior agreements of sale, prior encumbrances or any other litigation whatsoever. The vendor further promise and made the vendee believe that they have clear marketable title to the said property.
5) The vendor shall hand over the vacant physical possession of the property on the date of execution and registration of the sale deed.
6) If the vendor fails to execute and register the sale deed within the specified period i.e., 45 days from the date of execution of this indenture, even after the offer of the balance sale consideration, the vendor shall be liable to pay costs and damages to the purchaser as claimed by him.
7) The expenses for registration and stamp duty and all such other expenses related to registration shall be borne by the Purchaser only.

1) Can we sell the land to other party
2) What implications would arise if I register the land on others name without his notice to get rid of this nuisance

I would like to request you that kindly help me to get procedure to correct my age in index copy of registered flate.
Since I purchased under construction flate in vasai and registered it last year
(2012) with payment of required stamp duty and registration fee.
Now I observed that my age is wrong printed on index page.otherwise all details are correct including Pan No. etc is ok.
Kindly let me know that how I can make correction of my age on index page to avoid any confliction in future.

i wanted to open a bank account in the name of partnership firm and the bank is asking for the partnership deed ,but i am not able to trace the original partnership deed . the xerox copy may be found.

Case against lawyer
I have hired lawyer in Haryana for Divorce. He did nothing for me. I asked him to return my documents. He refused to give me back.
I have filed complaint against him is State Bar Council but there also nothing is going on. I have appeared four times before the Council and filed written complaint against lawyer. Council asked Lawyer to appear before it but he is lingering on and have not appeared. He has sent his reply in written and also an affidavit but never appeared personally.
Can I file case against lawyer in Consumer Court. Under which Law can I file case against him or I will have to file case against him in the court itself.
