i would like to know in detail what is the exact meaning of "NAVIN SHARTA LAND" any of the member of this forum please may come forward to elaborate the same.

what risk involved to purchase that land, if have purchased, how to protect oneself to avoid future uncertainty.

Power of attorney

Landlords joint owners (i.e. 2 brothers) have given irrevocable Power of Attorney to a developer after entering into development agreement with the developer. One of the landlord (i.e. 1 brother) has expired now.
Does the Power of Attorney remains in force even after one of the landlord has expired. The tenants of the building asking from the developer consent of all the heirs of the deceased landlord. Does the tenants have right to ask for consents of all the heirs from the developer.

Membership in the society

Sirs,

on or before 1950 My client's father has purchased a flat/room from one of his relative. when society formed he got 34 shares in the name of his wife and one share in his name (as he desired)so that as a member he can attend the meetings of the society. in the year 2000 he expired without making any will. now my client's mother is not well and wants to transfer the said room in the name of my client and his two sons. the other brothers and sisters of my client have no objection for the same and they are ready to give their consent for the same.

under the circumstances what documents I have to prepare and submit before the society?

please help me. it is little bit urgent as the mother of my client is not well.

Rent agreement

Dear Experts,

1. We are entering a rent agreement for 3 years and further one clause we want insert for further renewal of the same for next 2 years.Is this agreement valid in law OR bad in Law.

2. Can we execute a rent agreement more then 11 months with out registering the same in court of Law. Is this agreement enforceable in Law ?

3. Which documents can be Notarized through a Notary to make the documents valid in Law ?

Draft for discussion without prejudice: on stamp paper

I would like to know the meaning / ramification of having the heading/title of a business agreement (signed on a Rs. 50 Stamp paper) "DRAFT FOR DISCUSSION WITHOUT PREJUDICE".

The agreement details the roles and responsibilities between two parties where the first party manufacturers goods and the second party has agreed to sell the goods to a number of different third parties for a commission on the total volume of sales.

We are the second party. So does this mean that whatever commitments the first party have made on account of commissions or exclusivity of the customers introduced by us cannot be challenged in a court of law if not adhered to by the first party ?

Please advise.

Power of attorney -drafting

i am drafting a power of attorney to add an authorised signatory in a sole proprietorship bank account . can i print the contents on ledger papers (green papers),front and back side and get the franking of the documents done or is it mandatory to print on stamp paper.
when should the documents be franked ,before signing of all parties or after signing

I AM DRAFTING A POWER OF ATTORNEY TO ADD AN AUTHORISED SIGNATORY IN A BANK ACCOUNT ,CAN FRANKING BE DONE INSTEAD OF PRINTING IT ON A STAMP PAPER .IN CASE OF FRANKING, THE CONTENT IS ONLY OF TWO PAGES ,SHOULD I PRINT FRONT & BACK SIDES OF THE SAME PAGE OF PRINT ON TWO DIFFERENT PAGES (IN CASE OF FRANKING)

Partition for a future constructed property is allowed or not

Respected Sirs,
8 members have purchased a site as 2 members some yards and 3 members some yards and 3 members some yards of site in the same location and entire site adjacent to one another. Afterwards they jointly laid foundation for construction of Apartment on that site with their funds. Now the site is at foundation level only. Now they want to partition the property equally. They prepared a deed of partition for 8 equal shares. In the present partition it is recited that in the presence of their caste elders and also mediators conducted meeting for the allotment of flats that may be constructed and they agreed and accepted the flats allotted to them individually. In Andhra Pradesh there is a practice to enter a Development/Construction Agreement in which all the parties agree to construct the Apartment by themselves or by a another Developer/Construction Agency. For that Construction Agreement is being charged with Stamp Duty @5% on the total proposed constructions i.e., total floors area+Site+Car Parking +Stilt. In that Development Agreement also the Developer or the parties who upon the terms of Agreement develops the site divides the property i.e., Flats to the owners of the site. Though there is a Development Agreement and Partition in the said document, it is being treated as Development Agreement only according to the Commissioner and inspector General of Registration and Stamps, A.P. Hyderabad. But in the present case the parties only drawn a Partition for the future constructed floors also but not for the foundation level. But they are now paying stamp duty only on the foundation level partition. In this connection, respected sirs kindly enlighten me whether it is possible for partition for a future property i.e., floors to be constructed later on under Transfer of Property Act.

Please advise how to take legal hair certificate as my father passed away 2.5 years ago and my step mother is there but she is not well sound so i want to give up to my aunt (my fathers sister) how to get the legal hair of it.
