Gpa

Dear Sir,

I am Keshava, we have bought a site measuring 30x40 in outskirts of Bangalore, comes under Nagarabhavi Sub Registrar office jurisdiction in 2004 and the sale deed has been registered in Dec 2004.

my query is;

'A' - is the original land owner, and sold the land (1 acre 14 gunta) with registered sale deed in Mar 2004 to
'B' - who is the layout owner, and 'B' has given GPA to 'C' (through notarized) to sell / register the sites. We have purchased the above site from GPA holder 'C'. The site is also registered in our name in village panchayat, and we are paying the necessary taxes to the site to Village panchayat from 2004.

Please advice on the below

1) Is there any problem from the above transaction.
2) shall we get bank loan to construct the house(once the area is converted into corporation, rightnow it is under village pancyayat limit).

Request your valuable advice on the above.

Society membership application

Sir,

recently i got an assignment from a Co-op. housing society. Wherein i have to check the documents and applications of membership submit by new member/s of society. as i am not well experienced, i do not know what to check in those documents. the secretary of society is very co operative and she encourage me and told me that it is not very serious work and i have to accept the opportunity.

can any one guide me that what documents and what details i have to check in the documents?

Is it advisable to buy penthouse (topfloor) in bangalore ?

Hi Sir/Madam,

I have seen one Apartement and I liked it. and it is in my Budget. But this is a penthouse (topfloor) and it is A-khatha property.

And builder told, No Plan approval and you will have to pay the penality when Govt anounces for AKRAM & SAKRAMA.

Is it advisable to buy this kind of property..?

One of our Expert members given a response to a query that Any lease agreement for a period of less than 1 years does not require registration which is valid without any registration. Could you kindly elaborate?

Any lease for a period of less than 1 year DOES NOT REQUIRE compulsory registration.

Is it compulsory to register and pay stamp duty while leasing flats in a co op hsg socity?

Is it legally binding on the society to aceept leased documents which are only registered?

I want to take gift (by cheque) from my grandfather.
1: Is gift deed compulsory for this?
2: can cheque be from his firm's cheque or cheque must be from his saving a/c

Adding name in birth certificate

Hello,

I was born on 1987 in Kuniyamuthur panchayat, coimbatore. I have my birth certificate without name. kuniyamuthur panchayat is changed to corporation in the year 2011. What is the procedure to add my name in the birth certificate. When i go to kuniyamuthur panchayat office or registrar office or coimbatore corporation office no one is responding to me. No one is there to guide me regarding this. Can you please guide/Help me in this issue.

Seller refused to sell land as per agreement on rs 100 stamp paper

Sir I wanted to buy 1361x2=2722 Sq.Ft land in Patna. Seller has sold backside 1361Sq.ft & at the same time, Made an Non registered Agreement (on Rs 100 Stamp paper) for the front side land of 1361 Sq.ft to buyer. In that agreement it was mentioned that buyer had paid Rs 1Lakh for land and rest had to pay within 2months 15days deadline. After two weeks of agreement buyer went to seller house for paying remaining money(in cash as he demanded). He took away cash and agreement paper & went inside. After all if and buts, he hadrefused to sell land to buyer and began to abuse before so many people. Even he refused to return back the agreement paper. After people pressure he gave the agreement paper but edited it so many places & signed that is clearly visible.
Buyer Advocate had sent a notice to seller 15 days before, but he didn't answer. What should I do? He is even not ready to return whole amount(Rs nine lakhs). He is agreed to return only One lakh which is written in Agreement paper. Witness (who have also signed on agreement paper)are ready to say the fact That strenghten my position.
Sir what will happen if this matter goes to court for jurisdiction?

Token money

i had taken a token amount in cash of rs.50k for my flat in amritsar.i had clearly mentioned in the bayana papers that i have taken loan from nbfc against the flat.the buyer promised me to pay another rs.1 lac as part payment and directly deposit into my account by 10 sept 2011.however the buyer didnt deposit the stipulated rs.1 l in my account by 10 sept and made a cash deposit 49k in my account only on 13 sept.it was clearly mentioned that the token money shall be forefitd if the buyer does not deposit rs 1 lac in my account latest by 10 sept.however without seeking my consent the buyer arbitarily deposited cash in my account on 13 sept and that also just 49k.i sent the notice to party in oct which came back undelivered with remark no such person stays there.i had sent innumerous notices thru sms to buyer regaerding the deal called off in sept itself.buyer threatens me saying contract valid for 3 yrs inspite of the fact the contract clearly says the money forefited.what to do?

Registered a sale deed on basis of forged gpa

WE HAVE SOLD A PLOT AND BUYER GET SOME PAPERS SIGNED FROM RESIDANCE FROM MY MOTHER AND ALSO GOT SIGNED A RECEIPT OF FULL AND FINAL PAYENT, WITHOUT MAKING OF FULL PAYMENT. BUYER PUT THE FORGED STAMPS ON GPA AND SOLD THE SAID PLOT IN THE YEAR 2008 TO HIS FAMILY MEMBERS. WE COME TO KNOW THIS SALE DEED IN THE YEAR 2010. WE HAVE APPROACHED THE SAID TEHSILDAR AND GET A LETTER FROM TEHSILDAR MENTIONING THAT THE SAID GPA IS NOT REGISTERED. MATTER IS OF 2005. PL GUIDE ME WHAT STAPS WE HAVE TO TAKE AGAINST SAID PERSON.
