Birth certificate

Respected Experts
A lady's birth certificate shows her name, i.e. before marriage,to be different from the what she changed without any procedure after marriage. Her various documents like voter card, ration card and other documents show her name after marriage.
The issue of her got birth in his maternal parents home and the birth certificate shows name of his mother to be that what the name of her mother was before marriage. On the basis of the birth certificate the name of mother in the school records has been entered as what was before marriage.
My query is that what way should the mother adopt to get the name corrected in the school records to get her name after marriage incorporated in school records of her child as her main documents also show her name after marriage.
regards

Validity of such transaction - legally & tax point of view

Dear sir/madam

I wish to know validity of this transaction from legal as well as income tax point of view.

Mr. A wants to buy a flat in Pune by selling his non-agricultural (N.A.) plots located at native. The plots are located 11 kms from municipal limits and population of his native is less than 10,000. However Mr. A is physically challenged having paralysis attack, he can not travel. So he decided to give all money to his son who is in Pune to buy a flat for him (i.e. Mr. A). The flat will be purchased in the name of Son. All registration formalities will be done by his son. So he wants to make an affidavit stating he will sell his N.A. plots and give money to Son who, in turn, will buy a flat.

What is validity of such affidavit from Mr. A’ point of view? Whether will he liable to capital gain tax, from Mr. A and Son’s point of view? Reference to sections are welcomed.

Thanking You
Regards
Suraj

Cancellation of power of attorney

Sir
I am power of attorney holder of my father who is aged 65 years and widowed. The POA is general power of Attorney, registered and it is written in deed that I am being given power irrevocably. One of his lady acquaintances has developed closeness with him and started manipulating him. I am now shown a six month old letter addressed by my father to her mentioning that since I am misusing power of attorney he is cancelling power of attorney issued in my favor. No exact details of power of attorney i.e. registration number or date of POA are mentioned in letter. Father told me he was made to sign one letter whose content he was not told and therefore denies having written such letter. However he refuses to give any affidavit or letter in writing to the effect that he has not written any such letter fearing it may antagonize lady. I think lady would like to cancel this POA in my favor and make fresh POA in her favor. I have already used POA last month for disposing one of my father’s assets, realization of which I will credit into father’s bank account.

My queries are:

1) Since I (being POA holder) am not given any written communication by father but letter is addressed to lady mentioning cancellation, does it make POA null and void?
2) Since word irrevocable is mentioned in POA can he cancel POA?
3) I was told that mere mention of word irrevocable does not make POA irrevocable. Is it true?
4) Since exact details of POA are not mentioned in letter POA is still valid?
5) At present use of POA by me is valid and binding to him?
