The 16 members society does not want the managing committee to follow all the bye laws strictly. like change of user/not paying the maintenence/storage of material in the passages/drainage system rule etc because of that they refuse to accept/approve the audit report in the Agm. they just dont sign for approval of audit report but also not mentioning any reason for not approving the audit report. Is it necesary to approve the audit report by all the members including defaulter members ( 101 mcs act proceeding pending).only managing committee approves the audit report which is sufficient or not.please advise whether we should approach dy registrar to appoint their representative at the time of agm

The Audit report needs to be signed by the office bearers.After issue by the Audit officers,it has to be placed before the General body for approval.

The audit report contains and deliberated financial position of the society as on 31st March of last year i.e., income and expenditure statement, balance sheet etc. of the society for the financial year, which has to be passed by AGM. However, specific questions, if any, may be asked by the members in AGM.
If there are certain irregularities in accounting, as observed/pointed out by Auditor, the AGM can seek inquiry of the accounts through RCS.

Dear Experts,
thanks for early reply.As mentioned by you there is nothing objectionable or any irregularities mentioned in the auditors report but the defaulter members are adamant on not accepting that report. please suggest what is the solution for that.As per the mcs act the defaulter member has no right for voting or participate

Yes, the defaulter member cannot enjoy voting right and can be expelled from membership.
