Annulment of marriage

(Querist) 18 August 2009 This query is : Resolved 
Ld councels,

If both the husband and wife pray for annulment of marriage in separate peitions before family court but on different grounds will the court ask them to pursue for mutual divorce or will it condcut trail for both the cases.

Yes , The court may direct them to file under mutual consent in these circumstances. On refusal of either party for mutual consent, the court may proceed for further trial.

It will be mutual consent only, or merging of cases... but prayer is the same, so mutual consent only.
