respected experts thanks for timely response to my querry.sir your suggestions are very valuable but what is the correct legal recourse to adopted in delhi to prevent the sale of ancestral property before the sale transaction took place.can DV act2005 help in this case by way of stay order to sell or creating third party interest.

What is the right of the plaintiff? There are several different options to stop alienation.

File a suit for Declaration of undivided shares in the property & Injunction restraining sale immediately in the local Civil Court & try for an ad-interim order of Injunction. Further remedies,if available, may be pursued after deeper consideration of the matter.Remember, if the sale goes through,a 3rd. Party interest will be created complicating matters.

If tghe Party is Share Holder in the Ancestral proerty , he has to file suit for partition , for division, and for delivery of separate possesion and pendign suit he can obtain temporary injunction restrainign alienation by the Defendnat/s -
