1 If a company want to file a suit for recovering the "salary in lieu", where it will be filled, in normal civil court or any other court?
2 If the court order the defendant to pay amount, the company want to fill an E.P for recover the amount?
3. If E.P filled whether any properties of defendant have to be attached?
4. Please tell minimum how many years it will take if the defendant challenge the suit?

1) in bombay it takes 20 years for suit to be decided. 2) if defendant does not contest you can get decree faster 3)if amount claimed is over 50,000 in bombay suit has to be filed in high court

Civil suit will have to be filed by the company. yes EP has to be filed where the judgement debtor resides. If the suit is decreed then defendant has to file an appeal within 30 days from the date of the judgement and decree.

well that is the tragedy sir . long causes take over 20 years . commercial causes also take long time to be decided
