hello if a misconduct was committed 5 years ago and the govt employer starts disciplinary action now after lapse of 5 years. Is it justified and legal? besides would not it be difficult to prove the allegations?

Teh employer/Government is at liberty to take disciplonary action at any time during service.Yet, the procedure for disposing the same should be adopted.

It is the employer who has to decide the accurate time to initiate action against erring employee. Delinquent employee has got no right to dictate the terms of disciplinary action.
