Acquiring plot of land.

Querist : Anonymous (Querist) 20 September 2011 This query is : Resolved
We are using a plot of land for social causes for 17years.The tenant of the plot never objected and never came to see the plot of land for 30 yers. We organise social & cultural functions in the plot. Now the Tenant has arrived & wants back the plot. What legal action can we take to stop that ?
ajay sethi (Expert) 20 September 2011
you are not the owner of the property . the fact that for 17 years you have used the property for holding some functions does not make you the owner .
jitender pawaria (Expert) 20 September 2011
you filed a civil suit for permanent injunction on the basis of possession but you are not presume to be owner you can only protect possession.
prabhakar singh (Expert) 20 September 2011
The possession also can not be protected in view of the fact, that if on a vacant land you have been organizing some meeting or function
that does not confer vesting of right divesting from real owner, let any time length
pass,no adverse possession by some activity can be claimed, you can just delay few days, but you can not stop him using his property.
