A software development company cheated me

A company from tamilnadu has cheat me, I was wanted a android game to be developed , I and the Company agreed the deal on milestone payments as 25/25/25/25

25% is upfront to start the project and after i get the single player game i shall pay 25% again,the project should to be finished in 40days,But the company didnt gave me a valid working single player and the company doesn't want to refund money.

Please guide me which case should i file on this company.

Send a notice demanding refund of the money and compensation.
