Hi! I was previously married before, but the person I'm seeing now does not know that I was married. I'm already divorced. If I do not state on a marriage license application that I was previously married, would the marriage be void?
note: during my 1st marriage me and my wife both didnot stay together and the divorce was taken place just after a year, all these facts are hidden to my fiance so will my 2nd marriage be void even if i don ot state that i was married previously on a marriage license application? please some 1 reply asap...

Non the marriage would become oiid only because you have not disclose the divorce decree. No unless he cause necessary searches which is a herculean task anyway.

It is not advisable to conceal the real fact. In the application form for the registration of marriage there is a column " Status of the bride/ bride groom before the marriage- divorcee/ single". At last there is a verification that, all the contents of application is true.

Sir i cant understand wat are u trying to say, can you be a bit more clear. does the marriage registrar in wesbengal store all the previous marriage information by which my 2nd wife may come to know about my 1st marruage and divorce? what if i state that i am unmarried in the 2nd marriage notice application? Is there any chance that the registrar will come to know about my previous marriage?

Your first marriage and subsequent divorce is a material fact. It shall not be concealed with the person to whom you are marrying. After marriage, if she comes to know about it, she is entitled to file annualment case saying that you concealed material fact before and at the time of marriage and also made fraud. Then she will be entitled to anuulment decree.
Registration of your second marriage is not a problem because in that, you have to give an affidavit saying that you did not have any living spouse at the time of marriage. You can give such an affidavit because, the wife of earlier marriage is no more your spouse. I strongly suggest you to reveal all the facts of your earlier marriage to the fiancee and do not make fraud to avoid future ill consequences.

just non disclosure doesn't invalidate the second marriage but don't try to hide this. You may face criminal proceedings if you are not disclosing the true before nay authority.
