(i) whether you are an employee or

(ii) a practising Advocate?

(iii) are you having the taxable income for the first time?

Profession Tax is applicable as per the laws prevailing in that particular state where you are in practice.

With regards to Income tax - it purely depends on your nature of income whether you are in practice or employment.
