operation faild tubectomy

a poor lady who mother of three children after she operated satrilaisation (tubectomy) in govt. hospital .after 22 month she got prignant she cheked by govt. doctor but late in that condition can't mtp.now she bourn unwanted child. can govt.,doctor laiable for defecincy in service .can she get compansation from consumer forum. please advice with ruling of national comission or suprim court.

If it was fully govt hospital and the lady did not hire paid service of the doctor then deficiency of service as provided for in the consumer protection act would not lie though complaint to the higher authority may initiate punitive action against the erring doctor.

it is not good advice in this mater please cheke 2010(4) c.p.j. page no. 328. which is help for in govt .hospital case.please more give use full knowlege.thank you.
