Whether eligible fr accidental insurance claim if the driving licence has expired

(Querist) 02 July 2012 This query is : Resolved 
My Father expired in an road accident whereby he was hit by a truck . On the date of accident his driving licence had expired. He was 56/ 57 years by age at the time of accident.

He had an savings account with Axis Bank whereby the bank covers every account holder for accidenatl insurance for a sum of Rs 2 lakhs.

However on applying for the claim the insurance company declined to pass the claim citing the reason of expired driving licence.

The bank at the time of account opening had not described the details of conditions under which claim would be passed.
Is the Insurance company as well as the Bank correct in their decision to reject the claim.

Is there any possibility to claim the sum insured ?

You will need to go to court for this. The insurance company is following the terms of the policy document. There have been cases where compensation was given even when the D/L had expired

If there is no valid driving licence at the time of accident insurance take the defense of that and denies the claim. In such cases owner will be held responsible.
