What is the difference between Criminal and civil proceeding

Hello,

Could someone enlighten me on the difference in a suit with criminal proceedings and civil proceedings?

In the criminal proceeding provision of Cr.p.c apply and in civil proceeding provision of civil procedure code apply.

CIVIL DISPUTES AND REMEDY FOR COMPENSATION IN TERMS OF MONEY ARE FILED IN CIVIL COURTS AS PER PROVISIONS OF CIVIL PROCEDURE CODE. PARTIES ARE CALLED AS PLAINTIFF AND RESPONDENT.

CRIMINAL COMPLAINTS ARE FILED AT POLICE STATION FOR CRIME PUNISHABLE UNDER PROVISIONS OF INDIAN PENAL CODE.POLICE RECORD THE COMPLAINT AND FIRST INFORMATION REPORT (F.I.R.)MENTIONING DETAILS OF CRIME AND NAME OF ACCUSED IS SENT TO THE COURT.
KINDLY NOTE THAT POLICE FILE CASE IN THE NAME OF STATE AS COMPLAINENT.e.g.STATE OF MAHARASHTRA, STATE OF GUJRAT etc.
POLICE CONDUCT INVESTIGATION AND SEND DETAILED CHARGESHEET TO THE COURT.AND PRODUCE THE ACCUSED IN COURT.THEN PROVISIONS OF CRIMINAL PROCEDURE CODE ARE FOLLOWED AND ACCUSED IS EITHER CONVICTED OR ACQUITED BY THE COURT.

with reference to Domestic Violence an option has been given to the lady to choose between Criminal proceedings and Civil proceedings.

How does it effect the trial?

civil proceedings means proceedings before civil courts to enforce fundamental rights,contractual rights,property rights of the citizen. criminal proceedings means to enforce rule of state and to maintain discipline among people of the country. result of the civil proceeding may be in terms of money,property or contempt of the court by way of civil prison.compel litigant to do or prohibit to do something. on the contrary result of criminal proceeding may be punishment or penalty.

Civil proceedings are generally before civil-judge / Distt. Judge while Criminal proceedings are conducted in the court of Magistrate / Session Judge !
